Real Estate Attorney Jobs for OPT Students
Real Estate Attorney jobs on OPT require bar admission in at least one U.S. state, making early bar exam planning essential for F-1 students. Most roles are employer-sponsored under H-1B after OPT, and law firms and real estate companies regularly file for attorneys with active licenses.

How to Get Visa Sponsorship as a Real Estate Attorney
Prioritize bar admission before OPT ends
Pass the bar exam as early as possible. Most Real Estate Attorney roles require active state bar admission, and employers are far more willing to sponsor candidates who are already licensed rather than waiting on results.
Target law firms with active real estate practices
Mid-size and large law firms with dedicated real estate transactional practices sponsor attorneys regularly. Focus on firms handling commercial acquisitions, leasing, and development, where attorney headcount drives consistent H-1B filing patterns.
Highlight transactional experience in your applications
Real estate employers value hands-on experience with closings, title review, and contract negotiation. Internships, law clinic work, or prior deals in any jurisdiction demonstrate practical readiness and make sponsorship conversations easier to initiate.
Consider in-house legal roles at real estate companies
Large real estate developers, REITs, and property management companies hire in-house attorneys and sponsor visas. These roles often offer more direct sponsorship pathways than law firms, with clearer long-term employment relationships supporting the petition.
Network within state and local bar real estate sections
Joining the real estate law section of your state bar connects you with practitioners who hire directly. Many sponsoring employers find OPT attorneys through bar association events rather than traditional job postings, making in-person presence valuable.

Can I work as a Real Estate Attorney on OPT without passing the bar?
It depends on the role. You can work in a legal capacity, such as a law clerk or legal analyst, without bar admission. However, practicing as a licensed Real Estate Attorney requires passing the bar in the state where you work. Most attorney-titled positions will require bar admission before or shortly after your start date.
Does a law degree qualify for STEM OPT extension?
No. A Juris Doctor does not qualify for the 24-month STEM OPT extension because law is not classified under a STEM-designated CIP code. F-1 students with a JD are limited to 12 months of post-completion OPT, which makes early bar passage and employer sponsorship planning especially time-sensitive for this career path.
Which employers commonly sponsor Real Estate Attorneys on OPT or H-1B?
Law firms with active real estate transactional practices, in-house legal departments at real estate developers, REITs, and commercial lenders are the most common sponsors. Title insurance companies and large property management firms also hire and sponsor attorneys. You can browse Real Estate Attorney roles from sponsoring employers on Migrate Mate, which filters for OPT-friendly positions.
How does OPT authorization work for law firm employment?
Your OPT Employment Authorization Document authorizes full-time employment in any role directly related to your degree. For JD graduates, that includes attorney and legal professional roles. Your employer does not file any paperwork during OPT. You simply provide your EAD and I-20 to HR. Sponsorship for H-1B or another visa becomes the employer's responsibility after OPT ends.
Can I work for multiple clients or on a contract basis as a Real Estate Attorney on OPT?
OPT allows self-employment and contract work, provided each engagement is directly related to your degree field. However, practicing law through self-employment requires compliance with your state bar's rules on law firm ownership and unauthorized practice. Most F-1 students in law find traditional employment easier to document for both USCIS and bar ethics purposes.
