Position Summary
GEICO is seeking an experienced litigation attorney to lead and manage the Company’s privacy and cybersecurity litigation, as well assist on privacy- and cyber-related legal investigations. This role will handle a portfolio of data privacy, data security, and technology-driven disputes—including class actions and multi-plaintiff matters—and will direct or support internal and external investigations arising from data incidents, privacy complaints, and regulatory inquiries. The position will also support complex commercial, corporate, and intellectual property litigation impacting the Company’s operations, products, and strategic initiatives.
The successful candidate will partner closely with business, technology, and information security leaders while working within a collaborative legal department valued for providing practical, business-focused advice.
This position will report to the Senior Director for Corporate Litigation, Investigations & eDiscovery.
Primary Responsibilities
Privacy & Cybersecurity Litigation
- Manage and direct litigation involving data privacy, cybersecurity, data breach, and emerging digital-risk issues, including putative class actions and multi-plaintiff matters.
- Handle claims arising under federal and state privacy and consumer protection statutes, including wiretapping/session-tracking, biometric privacy, FCRA, TCPA, and comparable state analogues.
- Lead all phases of privacy and cyber litigation, including early case assessment, preservation and discovery strategy, motion practice, expert strategy, and trial preparation.
- Assess litigation risk, exposure, and potential business impact, and provide clear, actionable recommendations to senior leadership.
- Monitor and advise on emerging privacy, cyber, and technology litigation trends and their implications for the Company’s products, data practices, and business models.
- Coordinate and manage outside counsel, including oversight of strategy, budgets, and work product.
Privacy & Cyber-Related Investigations
- Direct and conduct privileged investigations involving data incidents, unauthorized access or disclosure, insider misuse of data, and privacy complaints.
- Partner with Information Security, Technology, Privacy, Compliance, and SIU on incident response, root-cause analysis, and remediation, including preservation and forensic coordination.
- Manage law enforcement inquiries, examinations, and third-party demands involving privacy and cybersecurity, and oversee responses in coordination with Compliance and Regulatory Affairs.
- Establish and apply consistent investigative protocols, documentation standards, and privilege safeguards across cyber and privacy matters.
- Evaluate investigation findings for downstream litigation, notification, and reputational risk, and advise on escalation and remediation.
Complex Commercial, Corporate & IP Litigation
- Manage complex commercial and corporate litigation, including contract disputes, business torts, and other high-exposure matters.
- Manage intellectual property litigation, including patent, trademark, trade secret, and related IP disputes.
- Develop litigation strategy in coordination with internal business and technical stakeholders.
- Partner with internal stakeholders across Legal, Finance, Operations, and Business Units to align litigation strategy with business objectives.
General Litigation & Advisory Support
- Counsel internal clients and senior leadership on litigation trends and risk exposure.
- Collaborate with cross-functional partners to support enterprise-wide legal initiatives.
- Monitor relevant legal developments and proactively advise on their business impact.
- Support additional corporate litigation and investigation matters as needed.
Basic Qualifications
- Juris Doctor (JD) degree from an accredited law school.
- Admission to practice law in at least one U.S. jurisdiction.
- 10+ years of litigation experience at a law firm, government agency, and/or in-house legal department.
- Substantial experience handling privacy, cybersecurity, data breach, or technology-related litigation.
- Experience conducting or directing investigations involving data privacy, cybersecurity, or technology issues.
- Working knowledge of federal and state privacy, data security, and consumer protection laws and regulatory frameworks.
- Strong analytical judgment and decision-making skills.
- Excellent written and verbal communication skills, with the ability to explain complex legal and technical issues to non-lawyers.
- Demonstrated ability to balance legal risk with business objectives.
- Proven ability to manage multiple matters, priorities, and stakeholders.
Preferred Qualifications
- Experience defending privacy or data breach class actions.
- Experience managing incident response and working directly with information security and forensic vendors.
- Experience with regulatory investigations or inquiries involving privacy or cybersecurity.
- Experience managing intellectual property or professional malpractice litigation.
- IP and patent litigation experience.
- Trial and/or appellate experience.
- Prior in-house experience or significant experience advising corporate clients.
- Experience working directly with business, technical, or product teams.
- Demonstrated leadership capability appropriate for a Senior Counsel role.

The above annual salary range is a general guideline. Multiple factors are taken into consideration to arrive at the final hourly rate/ annual salary to be offered to the selected candidate. Factors include, but are not limited to, the scope and responsibilities of the role, the selected candidate’s work experience, education and training, the work location as well as market and business considerations.
