How long does USCIS take to approve OPT (Form I-765)?

Most post-completion OPT applications are decided in 2 to 5 months: roughly 2 to 3 months for online filings and 3 to 5 months for paper, though processing times fluctuate month to month. Premium processing is available for an added fee and guarantees a decision within 30 business days. You cannot begin working until you receive your EAD card and its start date has arrived. A receipt notice alone is not work authorization.

When can I apply for OPT?

You can file Form I-765 with USCIS as early as 90 days before your program end date and no later than 60 days after it. USCIS must also receive your application within 30 days of the OPT recommendation date on your I-20. Miss that window and your case is denied, even if you are still inside the 90/60 filing window. What happens if I miss the 60-day OPT filing deadline?

If USCIS does not receive your I-765 within 60 days of your program end date, you lose OPT eligibility for that degree level. There is no extension and no appeal. Your remaining options are to transfer to a new SEVIS program, change status, or depart the U.S. within the same 60-day grace period. This is why most DSOs recommend filing as early as possible inside the 90-day pre-completion window.

Can I work or travel while my OPT application is pending?

No work is permitted until your EAD is approved and its start date has passed, not when you receive the receipt notice. Travel while the I-765 is pending is high-risk: re-entry requires a valid F-1 visa, a current I-20 with the OPT recommendation, your EAD, and ideally a job offer letter, so most international offices advise against leaving the U.S. between filing and approval.

When can I file for the STEM OPT 24-month extension?

You can file the STEM OPT extension I-765 up to 90 days before your current post-completion OPT EAD expires, and you must file before it expires. If USCIS receives a timely application, you get an automatic 180-day work authorization extension while the case is pending. Your employer must be E-Verify enrolled, and you must submit a signed Form I-983 training plan to your DSO before filing. What is the H-1B cap-gap extension?

Cap-gap automatically extends your F-1 status and OPT work authorization through September 30 if your employer files a timely H-1B petition (with an October 1 start date) while your OPT is still valid. It is automatic, with no separate application, but your DSO must issue an updated I-20 reflecting the extension. If your OPT has already expired when the H-1B is filed, you keep F-1 status during the gap but cannot legally work. How many days of unemployment am I allowed on OPT?

Post-completion OPT permits 90 cumulative days of unemployment, and STEM OPT adds another 60 days for a total of 150 across both periods. Days accrue from your EAD start date, not your graduation date. Exceeding the limit is a status violation: SEVIS will auto-terminate your record and you must depart the U.S. or change status.
