- Lead and manage all aspects of litigation involving restrictive covenants, errors and omissions, and contractual disputes, from pre-litigation strategy through resolution, including trial or hearing.
- Appear in court to argue motions, attend hearings, and conduct trials as necessary.
- Provide strategic counseling on hiring and onboarding practices, including pre- and post-hire risk assessments and mitigation strategies.
- Move quickly to obtain or defeat temporary restraining orders and preliminary injunctions in restrictive covenant disputes, often on an expedited or emergency basis.
- Draft, review, and negotiate legal documents related to disputes and settlements.
- Select, retain, and supervise outside counsel, manage budgets, strategy, and case outcomes.
- Provide strategic advice to business leaders on potential litigation risks, dispute avoidance, and contract enforcement.
- Develop and execute effective strategies for arbitration and alternative dispute resolution.
- Work closely with teams across Legal, Finance, and Operations to identify risks early and ensure alignment with business objectives.
- Prepare regular litigation reports and updates for executive leadership.
- Significantly contribute to the development of litigation protocols and e-discovery management systems.
- Monitor legal trends and regulatory developments that may affect the company’s litigation exposure
- Coordinate with the General Counsel on overall litigation strategy, prioritization, and resource allocation across the Legal Department.
- JD from an accredited school
- Active license and good standing in at least one U.S. jurisdiction. California bar admission a plus.
- Minimum of 8 years of relevant litigation experience, including restrictive covenant litigation, with substantial hands-on experience obtaining or defeating temporary restraining orders and preliminary injunctions in expedited proceedings
- Insurance industry experience preferred
- Ability to manage litigation and investigations internally, as well as manage outside counsel
- Proven ability to advocate effectively in court and other legal forums
- Demonstrated ability to think strategically and evaluate potential risks to the Company, including economic, legal, and reputational risks
- Develop creative and compliant solutions to assist in resolving complicated issues
- Excellent organizational and analytical skills. This position requires fast-paced multi-tasking and the ability to prioritize and manage multiple issues involving business partners in various locations
- Display the highest level judgment, ethical conduct, and integrity
- High degree of self-motivation, strategic thinking, and attention to detail
- Qualified applications with arrest or conviction records WILL be considered for employment. For positions in our organization that require a state insurance license to perform the duties described herein, applicants must meet the state licensing requirements as required by the applicable DOI, must not have been disqualified or barred from licensure, and must not have been prohibited from conducting the business of insurance under Title 18 U.S. Code, §§1033 and 1034 to qualify for that role
