Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a Tax Attorney
Verify your bar admission covers federal tax practice
H-1B petitions for Tax Attorney roles require proof of licensure in the state where you'll practice. If your role involves federal tax work across multiple states, confirm with your employer whether a single-state bar license satisfies the specialty occupation requirement.
Target employers with dedicated tax departments
Law firms with standalone tax practices, Big Four accounting firms with legal affiliates, and publicly traded companies with in-house tax counsel are the most consistent H-1B sponsors for this title. Search DOL Labor Condition Application filings by SOC code 23-1011 to identify active filers.
Search H-1B-sponsoring employers on Migrate Mate
Migrate Mate filters Tax Attorney job listings by employers with verified H-1B LCA filing history, so you're only seeing roles where sponsorship is already established practice rather than a conversation you have to initiate.
Confirm LCA wage level matches your experience tier
DOL certifies LCAs at four wage levels. A Level I filing for a senior tax position can trigger an RFE from USCIS. Use the OFLC Wage Search to check which level your employer intends to file and whether it aligns with your years of specialized tax experience.
Address LL.M. credentials in your petition clearly
A Tax LL.M. from a U.S. law school strengthens the specialty occupation argument for H-1B purposes. Include official transcripts and a credentials evaluation if your primary law degree is foreign, since USCIS scrutinizes non-J.D. pathways for attorney roles more heavily.
File during cap season if you're not cap-exempt
If your employer isn't a university, nonprofit research organization, or government entity, your H-1B is cap-subject. USCIS opens H-1B registration each March. Missing that window means waiting a full year, so align your job search and offer timing accordingly.

Find Tax Attorney JobsTax Attorney H-1B Visa: Frequently Asked Questions
Does a Tax Attorney role qualify as an H-1B specialty occupation?
Yes. USCIS classifies Tax Attorney under SOC code 23-1011, and the role's minimum requirement of a J.D. plus bar admission satisfies the specialty occupation standard. The position must require that specific degree in law, not just any bachelor's degree, which is clearly met for licensed attorneys practicing tax law.
Do law firms or in-house corporate teams sponsor H-1B visas more reliably for Tax Attorneys?
Both sponsor regularly, but the process differs. Large law firms typically handle H-1B filings in-house through dedicated immigration counsel and move quickly. In-house corporate legal departments at Fortune 500 companies also sponsor, but approval timelines depend on HR infrastructure. Check LCA disclosure data through OFLC to compare filing activity by employer before accepting an offer.
How do I find Tax Attorney jobs where employers are already open to H-1B sponsorship?
Migrate Mate shows Tax Attorney roles filtered by employers with active H-1B LCA filing history, so you can focus your applications on companies that have already demonstrated a pattern of sponsoring this role rather than negotiating sponsorship from scratch during the offer stage.
Can a foreign law degree support an H-1B petition for a Tax Attorney position?
It can, but USCIS scrutinizes foreign law degrees more closely for attorney roles. You'll typically need a credential evaluation showing your degree is equivalent to a U.S. J.D., active bar admission in at least one U.S. state, and documentation that the role requires that specific legal training. A U.S. Tax LL.M. alongside a foreign law degree substantially strengthens the petition.
What happens to my H-1B status if I move from a law firm to an in-house Tax Attorney role?
Changing employers requires a new H-1B petition filed by the new employer before your start date. Under H-1B portability rules, if your current petition has been approved for at least 180 days and you file the new petition while in valid status, you can begin the new role once the petition is received by USCIS without waiting for full approval.
