Verify your degree field matches the role
USCIS requires a direct connection between your degree and the Right of Way Agent position. Degrees in real estate, urban planning, civil engineering, or public administration typically satisfy specialty occupation requirements. A general business degree may trigger an RFE.
Target infrastructure and utility employers specifically
Pipeline companies, electric utilities, state DOT contractors, and engineering firms like AECOM or WSP file LCAs for Right of Way Agents far more consistently than commercial real estate firms. Filter your search by these employer types on Migrate Mate.
Check prevailing wage before negotiating your offer
Run your job title and work location through the OFLC Wage Search before any salary conversation. Your employer's LCA must certify wages at or above the DOL prevailing wage for your specific county, and underbidding yourself creates compliance problems later.
Document your right-of-way certifications for the petition
The International Right of Way Association's SR/WA designation strengthens your H-1B petition by demonstrating specialized knowledge. Include your certification letters and continuing education records in the supporting evidence package your employer submits with Form I-129.
Ask employers about cap-exempt filing options
Some Right of Way Agent roles sit inside universities, research institutions, or government contractors that qualify as cap-exempt H-1B employers. These employers can file year-round without lottery exposure, which matters if you're mid-project on OPT or another expiring status.
Confirm your O*NET job zone before the employer files
The O*NET profile for Right of Way Agents classifies this as a Job Zone 4 occupation requiring substantial preparation. Ask your employer's immigration counsel to cite this classification in the I-129 support letter to preempt specialty occupation challenges from USCIS.
H-1B Visa Right of Way Agent: Frequently Asked Questions
Does a Right of Way Agent role qualify as an H-1B specialty occupation?
Yes, provided the employer can demonstrate the position normally requires at least a bachelor's degree in a directly related field such as real estate, urban planning, or civil engineering. USCIS scrutinizes Right of Way Agent petitions more closely than some other professional roles, so the job description must clearly reflect degree-level analytical responsibilities, not just transactional land acquisition tasks.
Which types of employers sponsor H-1B visas for Right of Way Agents?
Electric and gas utilities, pipeline operators, state and local transportation contractors, and large infrastructure engineering firms are the most consistent H-1B sponsors for this role. Federal agencies and public universities that manage real property portfolios also hire Right of Way Agents and may file as cap-exempt employers. Use Migrate Mate to filter for employers with verified LCA filing history for this title.
How does the H-1B prevailing wage requirement affect Right of Way Agent offers?
Your employer must certify through an LCA that your offered wage meets or exceeds the DOL prevailing wage for Right of Way Agents in your specific work location. Wages vary significantly by region, especially between rural pipeline corridors and urban transit projects. Run the OFLC Wage Search using your SOC code and county before accepting an offer to confirm the employer's wage is compliant.
Can I switch Right of Way Agent employers while on H-1B status?
Yes, under H-1B portability rules, you can start working for a new employer once they file an H-1B transfer petition, as long as you're currently in valid status and your prior petition was approved. The new employer must file a new LCA certified for the specific project location, which matters for Right of Way roles that shift between job sites across county or state lines.
Does the SR/WA certification help with H-1B approval for this role?
It strengthens the petition but doesn't substitute for a qualifying degree. The SR/WA designation from the International Right of Way Association signals specialized professional knowledge and supports the specialty occupation argument, particularly if your degree field isn't a direct match. Immigration counsel typically includes it in the I-129 support letter to reinforce the position's complexity and degree-level requirements.
