Frame your portfolio around U.S. benchmarks
Australian AI research and industry experience is directly transferable, but U.S. hiring managers evaluate candidates against frameworks like MLOps maturity and responsible AI governance. Align your portfolio and resume language to those benchmarks before applying.
Target employers with active LCA filing history
Search DOL's Office of Foreign Labor Certification disclosure data to identify tech companies that have filed LCAs for AI or machine learning roles. Prior LCA activity signals the employer understands the E-3 process and won't stall at the sponsorship conversation.
Use Migrate Mate to streamline your filing
Once you have an offer, use Migrate Mate's E-3 filing service to handle your LCA and visa paperwork end-to-end, from DOL certification through consulate preparation, so you can focus on your start date rather than government forms.
Clarify your degree equivalency before interviews
Australian three-year bachelor's degrees in computer science, data science, or engineering are generally accepted as equivalent to U.S. four-year degrees for E-3 specialty occupation purposes. Have a credential evaluation ready if a recruiter raises questions early.
Address the specialty occupation standard proactively
Generative AI engineering must meet USCIS's specialty occupation definition: the role requires a degree in a specific technical field, not just any bachelor's. Ask your employer to document that the position requires AI, machine learning, or computer science expertise specifically.
Negotiate your start date around LCA processing
The DOL typically certifies an LCA within seven business days, but your employer needs to post a public notice at the worksite for ten consecutive business days before or after filing. Build at least three to four weeks between your offer acceptance and your consulate appointment.
E-3 Visa Generative AI Engineer: Frequently Asked Questions
How do I find Generative AI Engineer jobs with E-3 sponsorship?
Migrate Mate is built specifically for Australian professionals seeking E-3 sponsorship in the U.S. Search Generative AI Engineer roles on Migrate Mate to find employers already familiar with the E-3 process. Filtering by visa type upfront saves you from discovering late in the process that a company won't sponsor.
How much does it cost to get an E-3 visa?
Migrate Mate's E-3 filing service covers the entire process for $499, including the Labor Condition Application, visa document preparation, and consulate appointment guidance. Traditional immigration lawyers charge $2,000–$5,000+ for the same work. The E-3 has less paperwork than most work visas, so paying thousands for legal help is usually unnecessary.
Does a Generative AI Engineer role qualify as an E-3 specialty occupation?
Yes, provided the position requires a bachelor's degree or higher in a specific technical field such as computer science, artificial intelligence, or machine learning. Roles where any bachelor's degree would suffice, regardless of field, can fail the specialty occupation test. Your offer letter and job description should explicitly state the required degree field.
How does the E-3 compare to the H-1B for Generative AI Engineer roles?
The E-3 has a separate 10,500 annual cap exclusive to Australian citizens, and that cap has never been exhausted. The H-1B visa requires entering a lottery with roughly a one-in-four selection rate. For Generative AI Engineers with Australian citizenship, the E-3 offers a direct path to U.S. employment without waiting for lottery results or an annual registration window.
Can I change employers while on an E-3 as a Generative AI Engineer?
Yes, but you cannot port your existing E-3 status the way an H-1B holder can under AC21 portability rules. Your new employer must file a fresh LCA with the DOL and you'll need to attend a new consulate appointment for a new E-3 visa stamp. Plan for three to six weeks between your last day and your new start date to accommodate that process.
