E-3 Visa Real Estate Attorney Jobs
Real Estate Attorney roles qualify as E-3 specialty occupations when the position requires a law degree and active U.S. bar admission. Australian lawyers can secure E-3 sponsorship without competing in the H-1B lottery, and the visa renews indefinitely as long as you maintain qualifying employment at a U.S. law firm or in-house legal team.

Get Access To All JobsTips for Finding E-3 Visa Sponsorship as a Real Estate Attorney
Get your credentials assessed before applying
Australian law degrees are typically three years, not four. Have a credential evaluation from a NACI or NACES member agency ready to demonstrate equivalency to a U.S. J.D., so employers and USCIS don't raise degree questions mid-process.
Target firms with active real estate practices
Mid-size commercial real estate law firms and in-house legal teams at REITs or property developers file E-3 LCAs far more readily than generalist firms unfamiliar with the visa. Focus your outreach on legal departments where real estate transactions are a core practice area.
Clarify bar admission requirements with each employer
Some states allow foreign-trained lawyers to sit the bar directly; others require an LL.M. first. Confirm which state bar you're eligible for before accepting an offer, since your E-3 petition must list a specific work location and the role must require active licensure there.
Use Migrate Mate's E-3 filing service for your LCA and paperwork
The LCA must be certified by DOL before your visa interview, and attorney roles require careful prevailing wage documentation. Migrate Mate's E-3 filing service manages the entire process from offer to consulate appointment, reducing the risk of an administrative delay derailing your start date.
Address dual intent proactively at your consulate interview
Real estate attorneys often have long-term career plans in the U.S., which consular officers notice. Prepare a clear account of your intent to return to Australia if your E-3 status ends, backed by ties like property ownership, family, or professional registrations at home.
Negotiate employer-paid LCA and visa fees upfront
DOL regulations prohibit employers from passing LCA costs to E-3 workers, but legal roles sometimes see employers treat government filing fees as the employee's responsibility. Clarify in writing before signing your offer that the employer covers all E-3 filing and consular costs.

Find Real Estate Attorney JobsReal Estate Attorney E-3 Visa: Frequently Asked Questions
How do I find Real Estate Attorney jobs that offer E-3 visa sponsorship?
Migrate Mate is the most direct way to search for Real Estate Attorney roles where employers are already open to E-3 sponsorship. Because the E-3 has no lottery and a relatively straightforward filing process, many law firms and in-house legal teams that wouldn't consider H-1B sponsorship will sponsor an E-3 for a qualified Australian lawyer.
How much does it cost to get an E-3 visa?
Migrate Mate's E-3 filing service covers the entire process for $499, including the Labor Condition Application, visa document preparation, and consulate appointment guidance. Traditional immigration lawyers charge $2,000–$5,000+ for the same work. The E-3 has less paperwork than most work visas, so paying thousands for legal help is usually unnecessary.
Does a Real Estate Attorney role qualify as a specialty occupation for the E-3 visa?
Yes. Attorneys are firmly within the specialty occupation category because the role requires a Juris Doctor or equivalent law degree as a standard entry requirement. USCIS expects the position to require at minimum a bachelor's degree in a specific field, and a J.D. tied to a state bar admission meets that threshold without ambiguity for licensed legal roles.
How does the E-3 visa compare to the H-1B for Real Estate Attorneys?
The E-3 has several practical advantages for Australian lawyers. There's no annual lottery, so you can apply at any point in the year once you have a job offer and a certified LCA. H-1B has an 85,000-slot annual cap with a randomised selection process, meaning qualified attorneys are sometimes excluded purely by chance. The E-3 also processes through a consulate interview rather than a USCIS petition, which is typically faster.
Can an Australian lawyer practise real estate law in the U.S. on an E-3 without passing the bar?
No. The E-3 requires the role to be a specialty occupation, which for attorney positions means active state bar admission. You'll need to sit and pass the bar exam in the state where you'll be practising. Some states, including New York and California, allow Australian law graduates to sit the bar directly; others require an LL.M. first. Confirm your eligibility before accepting an offer.
