Get Access To All JobsTips for Finding Green Card Sponsorship in HR Generalist
Align your credentials with PERM requirements
PERM requires employers to advertise the exact minimum requirements they'll use to evaluate your application. If your HR degree is from outside the U.S., get a credential evaluation now so your employer can accurately list the requirement without delays.
Target employers who run SHRM-certified HR teams
Companies with structured HR departments and SHRM-certified staff are more likely to understand the PERM process internally. Look for job postings that list PHR or SPHR certification as a preferred qualification, those employers already treat HR as a formal professional function.
Search for green card sponsors using Migrate Mate
Filter by HR Generalist roles at employers with active EB-2 and EB-3 filing history. Migrate Mate surfaces companies that have sponsored foreign HR professionals before, so you're not guessing which employers will take on PERM sponsorship.
Confirm the prevailing wage tier before accepting an offer
DOL assigns your role a wage level based on duties and experience. Use the OFLC Wage Search to look up the prevailing wage for HR Generalist in your target city. A Level I or II classification can affect whether your offer will clear DOL's review.
Ask about the employer's PERM attorney during the offer stage
Some companies handle PERM filings in-house; others outsource to outside counsel. Asking early tells you how organized their process is. A dedicated immigration attorney on retainer usually means faster filing and fewer avoidable delays in your labor certification.
Document your specialized HR duties before the I-140 stage
USCIS scrutinizes whether HR Generalist roles meet the specialty occupation standard for EB-2. Keep records of duties tied to specific HR functions, benefits administration, HRIS management, or workforce planning, rather than general administrative tasks, to support your petition.

Find HR Generalist JobsHR Generalist Green Card Sponsorship: Frequently Asked Questions
Does an HR Generalist role qualify for EB-2 or EB-3 green card sponsorship?
HR Generalist positions typically qualify under EB-3 when the employer requires a bachelor's degree in human resources, business, or a related field. EB-2 eligibility applies when the role requires an advanced degree or the candidate holds a master's degree or higher and the job duties reflect that level of specialization. Your employer's attorney will determine the correct category based on the actual job requirements and your credentials.
How does PERM green card sponsorship differ from H-1B for HR Generalist jobs?
H-1B is a temporary work visa with a cap, an annual lottery, and a maximum six-year duration for most holders. PERM-based green card sponsorship leads to permanent residency with no annual renewal once approved, and EB-3 has no lottery. The tradeoff is timeline: PERM typically takes one to two years from labor certification to I-140 approval before you even reach the visa queue, compared to H-1B's faster initial authorization.
Which employers actually sponsor green cards for HR Generalist positions?
Larger corporations, multinationals, and companies with established HR departments are the most consistent green card sponsors for HR roles. Employers already familiar with immigration compliance, including those enrolled in E-Verify, tend to have internal processes for managing PERM filings. Use Migrate Mate to filter HR Generalist openings by employers with verified EB-2 and EB-3 sponsorship history so you can focus your applications strategically.
Can my employer start the PERM process while I'm on an H-1B or OPT?
Yes. PERM labor certification can be filed while you're working on any valid work authorization, including H-1B or OPT. The PERM application is employer-initiated and separate from your current status. Starting early matters because PERM processing at DOL currently averages well over a year, and your priority date, which determines your place in the visa queue, is set when the PERM is filed.
What does the DOL's PERM process actually involve for an HR Generalist role?
Your employer must conduct a supervised recruitment campaign showing no qualified U.S. workers were available for the position. DOL requires specific advertising steps, including job postings, newspaper ads, and an internal notice. The employer then submits Form ETA-9089 through the PERM system. Because HR Generalist is a common job title, DOL audit rates can be higher, so precise documentation of duties and minimum requirements is critical to avoid delays.
