Align your credentials to PERM requirements
PERM requires your education and experience to match the job description exactly. A bachelor's degree in human resources, business administration, or a closely related field strengthens your EB-3 case and reduces the risk of DOL audit delays.
Target employers with active PERM filing history
HR Assistant roles are sponsored most often by large healthcare systems, universities, and multinationals with in-house HR infrastructure. Search OFLC disclosure data to identify employers who have filed PERM certifications for administrative HR titles in the past two years.
Search sponsoring employers using Migrate Mate
Use Migrate Mate to filter Human Resources Assistant openings by employers with documented green card sponsorship history. This cuts the time you spend applying to companies that will decline to sponsor once you disclose your immigration status.
Verify the prevailing wage before accepting an offer
Your employer must pay at least the DOL prevailing wage for your geographic area and experience level. Use the OFLC Wage Search to look up the wage tier for your role before the offer stage, so you can flag discrepancies before PERM is filed.
Understand how O*NET classification affects your petition
USCIS and DOL use the O*NET occupation profile to evaluate whether HR Assistant duties qualify as skilled work under EB-3. Roles coded at Job Zone 3 or higher with defined degree requirements are the strongest candidates for approval.
Ask about PERM timing before the I-140 stage
PERM currently takes many months for analyst review at DOL. Ask your prospective employer whether they plan to file PERM immediately upon hire or after a probationary period, since delays at this stage directly affect when your I-140 petition can be submitted.
Green Card Human Resources Assistant: Frequently Asked Questions
Do Human Resources Assistant roles typically qualify for EB-2 or EB-3 sponsorship?
Most Human Resources Assistant positions qualify under EB-3, which covers skilled workers and professionals with a bachelor's degree. EB-2 is possible if the role requires an advanced degree or if you have a master's degree and the employer structures the position accordingly. The job description filed in the PERM labor certification determines which category applies, so the employer's attorney or HR team needs to draft duties carefully to match your qualifications.
How does green card sponsorship differ from H-1B for an HR Assistant role?
H-1B visa requires the role to qualify as a specialty occupation and is subject to an annual lottery, creating uncertainty. EB-3 green card sponsorship through PERM has no annual cap on petition filings, though visa number backlogs affect when you can complete adjustment of status depending on your country of birth. Green card sponsorship is also permanent, resulting in lawful permanent residency rather than a temporary status that must be renewed.
How long does the PERM and green card process take for an HR Assistant?
The PERM labor certification at DOL is currently taking many months, followed by I-140 petition processing at USCIS, which can add several additional months without premium processing. After I-140 approval, nationals of countries without visa backlogs can file for adjustment of status relatively quickly, while nationals of high-demand countries like India and China face significantly longer waits due to per-country visa limits.
What documentation should I prepare before asking an employer to sponsor my green card?
Gather official transcripts confirming your degree in human resources, business administration, or a related field, along with employment verification letters from prior HR roles that list your specific duties and dates of employment. USCIS requires this evidence at the I-140 stage to confirm you meet the minimum requirements stated in the PERM-certified job description. Having these documents ready before you approach an employer signals that you are a low-friction candidate to sponsor.
Where can I find HR Assistant jobs where the employer is already open to green card sponsorship?
Use Migrate Mate to search Human Resources Assistant roles filtered by employers with verified green card sponsorship history. This avoids the common frustration of reaching the offer stage only to learn the employer does not sponsor immigration cases. Targeting employers who have already filed PERM certifications for similar roles significantly increases the likelihood that your sponsorship request will be approved internally.
