Green Card Tax Attorney Jobs
Tax Attorney roles qualify for EB-2 sponsorship when the position requires a J.D. plus an LL.M. or equivalent advanced credentials, and for EB-3 when a J.D. alone satisfies the minimum requirement. Employers file a PERM labor certification with DOL before petitioning USCIS, making sponsorship a multi-year commitment that serious law firms and corporate legal departments do undertake.

Credential your foreign law degree early
A foreign J.D. or LL.B. must be evaluated for U.S. equivalency before PERM filing begins. Get a credential evaluation from a NACES-member organization and confirm your degree maps to a U.S. J.D. or qualifying advanced degree for EB-2 purposes.
Target corporate legal departments over law firms
In-house legal teams at large corporations sponsor Tax Attorney roles more consistently than private law firms, because in-house positions are classified as permanent employment from day one, which simplifies the PERM labor certification process for the employer.
Verify the prevailing wage tier before negotiating
Use the OFLC Wage Search to look up the prevailing wage for Tax Attorney roles in your target city before any offer discussion. PERM requires your offered salary to meet or exceed the DOL wage level, and accepting below that level will block certification.
Search green-card-sponsoring employers on Migrate Mate
Filter by Tax Attorney roles on Migrate Mate to find employers with active EB-2 and EB-3 sponsorship history. This cuts the time you'd otherwise spend cold-approaching firms that have never filed a PERM petition.
Clarify EB-2 versus EB-3 classification at offer stage
Ask the employer which category they intend to use before signing. EB-2 requires an advanced degree or a National Interest Waiver, while EB-3 covers professionals with a standard J.D. Each category has different priority date implications depending on your country of birth.
Confirm bar admission requirements during PERM drafting
PERM job descriptions for Tax Attorneys must list state bar admission as a requirement if the employer genuinely requires it. If bar admission in your jurisdiction is pending, work with your employer to align the PERM filing timeline with your expected admission date.
Green Card Tax Attorney: Frequently Asked Questions
Do Tax Attorney roles typically qualify for EB-2 or EB-3 sponsorship?
Most Tax Attorney positions qualify for EB-2 because the role normally requires at minimum a J.D., and many employers require an LL.M. in taxation, which satisfies the advanced degree standard. If the job description requires only a J.D. with no advanced degree, EB-3 as a professional is the appropriate category. The employer and their immigration counsel determine which category to file based on the actual minimum requirements for the position.
How does green card sponsorship differ from H-1B sponsorship for Tax Attorneys?
H-1B visa is a temporary nonimmigrant status capped at 85,000 new visas per fiscal year with a lottery for most applicants, while EB-2 and EB-3 green card sponsorship through PERM is a permanent pathway with no annual cap at the petition level. The tradeoff is time: PERM labor certification alone can take six to twelve months before USCIS even receives the I-140 petition, and applicants from India or China face additional wait times due to per-country priority date backlogs.
Which types of employers are most likely to sponsor Tax Attorneys for a green card?
Corporate legal departments at publicly traded companies, Big Four accounting firms with legal advisory arms, and large financial institutions sponsor Tax Attorney roles with the most regularity. These employers have established immigration programs and treat PERM filings as a standard part of talent retention. Smaller boutique tax law firms sponsor less frequently, but regional firms with international client bases do file PERM petitions for foreign-trained attorneys with specialized expertise.
How can I find Tax Attorney jobs that offer green card sponsorship?
Use Migrate Mate to search Tax Attorney roles filtered by employers with EB-2 and EB-3 sponsorship history. This lets you focus your applications on legal departments and firms that have already demonstrated willingness to sponsor foreign professionals through PERM, rather than relying on job descriptions that often omit sponsorship details entirely.
What does the PERM process look like for a Tax Attorney position?
The employer must conduct a DOL-mandated recruitment campaign to demonstrate no qualified U.S. workers are available for the role, then file an ETA Form 9089 with the Department of Labor. For a Tax Attorney position requiring a specific advanced degree or bar admission, the employer's job description in the PERM filing must precisely match what they genuinely require. After PERM certification, the employer files an I-140 immigrant petition with USCIS, and you apply for adjustment of status once your priority date becomes current.
