H-1B Visa Adjunct Instructor Jobs
Adjunct Instructor roles qualify for H-1B visa sponsorship when the position requires a bachelor's degree or higher in a specific field, typically met by teaching in your discipline. Universities and community colleges file H-1B petitions under cap-exempt status if they qualify as institutions of higher education, which means no lottery and no October 1 start date requirement.

Verify your institution's cap-exempt status
Not every college qualifies as cap-exempt under USCIS rules. Confirm your prospective employer is an institution of higher education or a related nonprofit before accepting a role, cap-exempt status eliminates lottery risk entirely.
Document your specialty occupation credentials early
USCIS scrutinizes adjunct roles heavily. Gather syllabi, course catalogs, and department requirements showing a specific degree field is mandatory for your position, not just preferred, before your employer files the I-129.
Search H-1B sponsors on Migrate Mate
Filter for institutions with active LCA filings in education occupations on Migrate Mate. You'll see which employers have filed for adjunct and instructor roles specifically, so you're targeting schools with real H-1B sponsorship history.
Use OFLC Wage Search before salary negotiations
Your employer's LCA must certify wages at or above the DOL prevailing wage for your SOC code and location. Run the OFLC Wage Search yourself so you know the floor before your offer letter is drafted.
Clarify part-time vs. full-time H-1B terms upfront
Adjunct roles are often part-time. USCIS allows part-time H-1B petitions, but your approved hours are binding. Get the exact weekly hours written into your offer letter to match what your employer files on the I-129.
Request premium processing for semester-bound start dates
Academic hiring runs on fixed semester timelines. Standard processing won't guarantee approval before classes begin. Ask your employer to use USCIS premium processing so your status is confirmed before your first teaching assignment.
H-1B Visa Adjunct Instructor: Frequently Asked Questions
Do adjunct instructor positions qualify as specialty occupations for H-1B purposes?
Yes, if the role requires a bachelor's degree or higher in a specific academic discipline directly related to the courses taught. The key is that the degree requirement must be a genuine minimum, not just a preference. Generic teaching roles where any degree qualifies are harder to support. Your employer should tie each course you teach to your specific field of study in the LCA and I-129 filing.
Can a community college sponsor an adjunct instructor for H-1B status without going through the lottery?
Community colleges that qualify as institutions of higher education under the Immigration and Nationality Act are cap-exempt employers. This means they can file H-1B petitions at any time of year and aren't subject to the annual 85,000-slot cap or lottery. Confirm cap-exempt status with the HR or legal office before assuming it applies, as not every affiliated campus entity automatically qualifies.
How do I find colleges and universities actively sponsoring H-1B visas for instructor roles?
Search Migrate Mate to filter employers with verified LCA filing history in education occupations. DOL LCA disclosure data shows which institutions have filed for instructors and adjunct roles, giving you a concrete list of H-1B-active employers rather than guessing based on school size or reputation.
What happens to my H-1B status if my adjunct contract ends at the semester boundary?
H-1B status is tied to your employment with the petitioning employer. If your adjunct contract isn't renewed, your authorized stay ends with your employment. You have a 60-day grace period to find a new employer willing to file an H-1B transfer, change to another valid status, or depart the U.S. Notify your department early if renewal is uncertain so your employer has time to file an amended petition if contract terms change.
Can I hold multiple adjunct positions at different schools on a single H-1B?
No, each employer must file a separate H-1B petition. If you teach at two institutions simultaneously, both schools need to sponsor you individually and both petitions must be approved. Each LCA must reflect the correct hours and wage for that specific position. USCIS treats each employer relationship as a distinct H-1B, so approval from one school doesn't extend to another.
