Verify your degree meets specialty occupation
USCIS requires your bachelor's degree field to directly relate to the teaching role. A degree in English Literature, TESOL, Linguistics, or Education typically qualifies. A general humanities degree may trigger an RFE, so gather transcripts that show coursework alignment before applying.
Target cap-exempt employers first
Universities, nonprofit educational organizations, and government research institutions are cap-exempt, meaning no lottery and no October 1 start date restriction. Applying to these employers gives you a faster, more predictable path to H-1B status than private K-12 schools.
Search LCA filings to find active sponsors
Use Migrate Mate to filter employers by verified H-1B LCA filing history for teaching roles. This shows you which schools and language programs have actually sponsored teachers before, not just those who claim they're open to sponsorship.
Confirm the employer will file the LCA first
Your employer must file a Labor Condition Application with DOL and receive certification before USCIS can process your H-1B petition. Ask hiring managers explicitly whether their HR team has done this for teachers before, since many smaller private schools haven't.
Check prevailing wage requirements for your location
The LCA locks in a wage level tied to your specific location and job title. Use the OFLC Wage Search to look up the prevailing wage for English teachers in your target city before negotiating your offer, so the employer's offer meets DOL requirements.
Get your foreign credentials evaluated early
If your degree is from outside the U.S., obtain a credential evaluation from a NACES-member service before job applications. USCIS adjudicators scrutinize foreign degree equivalency in teaching petitions, and delays in evaluation can push back your petition filing timeline.
H-1B Visa English Teacher: Frequently Asked Questions
Does an English Teacher role qualify as a specialty occupation for H-1B purposes?
Yes, if the employer requires at least a bachelor's degree in a directly related field such as English, Education, TESOL, or Linguistics. The key is that the degree requirement must be tied to the specific role, not just preferred. Positions at accredited schools and universities are stronger candidates than informal tutoring or adult education roles where degree requirements are less defined.
Which types of employers sponsor H-1B visas for English Teachers?
Universities and community colleges are the most active sponsors and are cap-exempt, so you can start any time of year without waiting for the lottery. Private language schools, international K-12 schools, and some public school districts also sponsor, but they're cap-subject. You can find employers with verified H-1B filing history for teaching roles on Migrate Mate, filtered by location and occupation.
Can I switch from an F-1 OPT or STEM OPT extension to an H-1B as an English Teacher?
Yes, if you're on OPT and receive an H-1B approval from a cap-subject employer, your status transitions on October 1 of that fiscal year. For cap-exempt employers like universities, the transition can happen any time. Your employer must file before your OPT expires, so coordinating the petition timeline with your EAD end date is critical.
What documents should I prepare before an employer files my H-1B petition?
You'll need your passport, all academic transcripts and diplomas, a credential evaluation if your degree is from outside the U.S., any teaching licenses or TESOL certifications, and a detailed resume showing your relevant experience. If you have a foreign degree, get the NACES evaluation done early since it can take several weeks and delays will push back your petition filing date.
Does a teaching license affect H-1B eligibility for English Teachers?
A state teaching license strengthens your petition by demonstrating that the role meets a professional standard requiring specialized training. However, it doesn't replace the degree requirement. USCIS still needs to see that a bachelor's degree in a specific field is the minimum entry requirement for the position, which the employer establishes through the LCA and job description.
