Get Access To All JobsTips for Finding H-1B Visa Sponsorship as an Education Counselor
Verify your degree meets specialty occupation
USCIS requires your degree field to directly relate to the Education Counselor role. A counseling, psychology, or education degree is cleanest. A business degree with no counseling coursework will draw an RFE, so gather transcripts and course descriptions now.
Target universities and school districts first
Colleges, universities, and large public school districts file H-1B petitions regularly and often hold cap-exempt status. Cap-exempt employers can file any time of year, skipping the April lottery entirely and cutting your wait by months.
Search LCA filings for Education Counselor roles
Use Migrate Mate to filter employers by Labor Condition Application filing history for Education Counselor positions. This shows you which organizations have actually sponsored this role, not just which ones say they're open to sponsorship.
Check the prevailing wage before negotiating
Your offer must meet the DOL prevailing wage for your specific county and experience level. Run the OFLC Wage Search using the Education Counselor SOC code before you negotiate so you know the floor your employer must meet.
Ask employers about their cap-exempt status early
Many education employers qualify as cap-exempt institutions of higher education or affiliated nonprofits. Confirm this in the first conversation with HR. Cap-exempt status removes lottery risk and lets your employer file your petition any time you're ready.
Time your offer letter around the 60-day grace period
If you're transitioning from OPT or a previous H-1B, you have a 60-day grace period after your end date. Your new employer needs to file before that window closes, so align your offer letter and start date with enough lead time for USCIS processing.

Find Education Counselor JobsEducation Counselor H-1B Visa: Frequently Asked Questions
Does an Education Counselor role qualify as a specialty occupation for H-1B purposes?
Yes, if the position requires at least a bachelor's degree in a specific field such as counseling, psychology, social work, or education. Generic postings that list a degree as preferred rather than required can complicate the petition. Ask your employer to confirm the degree requirement is stated as mandatory in the job description before they file.
Which employers sponsor H-1B visas for Education Counselors most often?
Universities, community colleges, and large school districts file the most H-1B petitions for this role. Many qualify as cap-exempt institutions, meaning they can file outside the annual lottery window. Nonprofit college-access organizations affiliated with a university can also carry cap-exempt status. Use Migrate Mate to search employers with verified LCA filing history for Education Counselor positions.
What is the H-1B prevailing wage requirement for Education Counselors?
DOL sets prevailing wages by occupation, geographic area, and experience level. Your employer must pay at least the prevailing wage for your county under the Education Counselor SOC code before USCIS will approve the petition. You can verify the applicable wage using the OFLC Wage Search tool. Offers below that threshold will result in LCA denial.
Can an Education Counselor employer file an H-1B petition outside the April lottery?
Yes, if the employer qualifies as cap-exempt. Institutions of higher education, affiliated nonprofits, and certain government research organizations are exempt from the annual H-1B cap. Cap-exempt filings are accepted year-round, so there's no lottery risk and no fixed filing window. Confirm cap-exempt status with HR before accepting an offer, since not every education employer qualifies.
What happens to my H-1B status if I move from one education employer to another?
H-1B portability under AC21 lets you start work with a new employer once they file an H-1B transfer petition, without waiting for approval. Your status is maintained during the transfer as long as your previous petition was valid and the new role is in the same or a similar occupational classification. Your new employer must file before your current authorized period ends.
