Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a Clinical Assistant Professor
Verify your institution qualifies as cap-exempt
Universities, colleges, and affiliated nonprofit research organizations are typically cap-exempt H-1B employers. Confirm this status before accepting an offer so your petition isn't subject to the annual lottery and 85,000-slot cap.
Match your degree field to your teaching area
USCIS scrutinizes whether your academic credentials directly relate to the courses you'll teach. A clinical assistant professor in occupational therapy needs a degree in that field, not a broadly related health science discipline.
Check prevailing wage before negotiating your offer
Your employer must certify your salary meets the DOL prevailing wage for your specific job title and location. Run your role through the OFLC Wage Search before finalizing your offer letter to avoid LCA complications later.
Use Migrate Mate to find verified H-1B-sponsoring universities
Institutions with active LCA filing history for clinical faculty roles show up on Migrate Mate, filtered by occupation code. This lets you target departments that have completed the DOL and USCIS process before, not just those that say they're open to sponsorship.
Request a start date aligned with your petition timeline
Cap-exempt academic employers can file at any point, but USCIS standard processing still runs several months. Negotiate a start date that gives your employer enough lead time to file Form I-129 without needing premium processing.
Confirm your clinical duties don't require state licensure before filing
If your role involves direct patient care or supervised clinical instruction, some states require licensure before USCIS will approve the H-1B petition. Identify any licensing requirements through your state's professional board well ahead of the filing date.
H-1B Visa Clinical Assistant Professor: Frequently Asked Questions
Do Clinical Assistant Professor positions qualify as H-1B specialty occupations?
Yes. Clinical Assistant Professor roles typically qualify because they require at minimum a bachelor's degree in a directly related field such as nursing, physical therapy, medicine, or a clinical health science. USCIS evaluates both the theoretical and applied nature of the work. Your job duties and degree field must align clearly, and your employer documents this in the H-1B petition.
Are universities cap-exempt for H-1B sponsorship?
Most accredited universities and their affiliated nonprofit clinical sites are cap-exempt H-1B employers. Cap-exempt status means your employer can file Form I-129 at any time of year without entering the lottery or competing for the 85,000 annual cap slots. Confirm your specific institution's cap-exempt status with HR or legal counsel before relying on this timeline.
How do I find Clinical Assistant Professor employers that actively sponsor H-1B visas?
The most direct method is searching employers with verified LCA filing history for clinical faculty roles. Migrate Mate filters institutions by occupation code and DOL filing activity, so you can identify universities that have completed the H-1B process for positions like yours rather than those that are theoretically open to sponsorship but have no filing track record.
Can I switch from an OPT or J-1 visa to H-1B as a Clinical Assistant Professor?
Yes. If you're currently on OPT, your cap-exempt university employer can file an H-1B change of status petition without waiting for April 1. J-1 visa to H-1B transitions work similarly for cap-exempt employers, but check whether your J-1 carries a two-year home residency requirement, since that must be waived or fulfilled before USCIS can approve the H-1B.
What role does the LCA play in hiring a Clinical Assistant Professor on H-1B?
Before filing Form I-129 with USCIS, your employer must certify a Labor Condition Application with the DOL. The LCA confirms the offered salary meets the prevailing wage for your role and location, and that hiring you won't adversely affect similarly employed U.S. workers. DOL must certify the LCA before the H-1B petition can be submitted.
