Get Access To All JobsTips for Finding H-1B Visa Sponsorship in Education
Target cap-exempt employers first
Universities, nonprofit research institutions, and government-affiliated colleges are exempt from the H-1B annual cap and lottery. Prioritizing these employers means you can start any time of year, not just during the April filing window.
Verify your degree field matches the role
USCIS scrutinizes Education petitions closely because many teaching roles accept any bachelor's degree. Confirm your degree is in the specific subject area you'll teach or administer, not just a general education credential.
Check prevailing wage before accepting an offer
Run your job title and location through the OFLC Wage Search before signing anything. Your employer's LCA must certify a wage at or above the prevailing level, and underpaying is a common cause of audit issues in Education.
Use Migrate Mate to find Education employers with H-1B filing history
Filter by Education roles on Migrate Mate to see which school districts, universities, and ed-tech companies have actively filed H-1B petitions. This saves time you'd otherwise spend cold-contacting employers unfamiliar with the sponsorship process.
Get your foreign credentials evaluated early
If your teaching degree is from outside the U.S., get a credential evaluation from a NACES-member organization before applying. Many Education employers and state licensing boards require this before they'll initiate an H-1B petition.
Ask your employer about cap-gap protection
If you're transitioning from OPT to H-1B at a cap-subject employer, your work authorization automatically extends under cap-gap rules while your petition is pending. Confirm your employer files before your OPT end date to preserve this protection.
H-1B Visa Education: Frequently Asked Questions
Do Education jobs qualify as specialty occupations for H-1B purposes?
Most professional Education roles qualify, but the bar varies by position. Postsecondary instructors, curriculum specialists, and educational researchers typically qualify because they require a degree in a directly related field. K-12 teaching roles can be more complicated since many states allow alternative certification pathways. USCIS looks at whether a specific bachelor's degree in a relevant discipline is a standard industry requirement for the role.
Which types of Education employers are most likely to sponsor H-1B visas?
Colleges and universities are the most active H-1B sponsors in Education because many are cap-exempt, meaning no lottery. Private K-12 schools, nonprofit ed-tech companies, and curriculum publishers also sponsor regularly. Public school districts sponsor less frequently due to budget constraints and HR capacity, though it does happen. Browse Education roles on Migrate Mate to see which employers have verified H-1B filing history.
What is cap-exempt status and how does it apply to Education employers?
Cap-exempt employers can file H-1B petitions at any point during the year without entering the annual lottery. Universities, colleges, nonprofit research organizations, and government-related educational institutions typically qualify. This is significant for Education job seekers because you aren't locked to the April registration window. Confirm an institution's cap-exempt status with HR before assuming you can start on your preferred timeline.
Can my Education employer sponsor me for H-1B if I'm currently on OPT?
Yes. Your employer files an H-1B petition during the regular registration period, and if selected, your status converts on October 1. If your OPT expires before October 1, cap-gap rules extend your work authorization automatically while the petition is pending, as long as your employer filed before your OPT end date. STEM OPT holders get additional runway if the role qualifies under a STEM-designated program.
What documentation does an Education employer typically need to file an H-1B petition for me?
Your employer will need your academic transcripts and degree certificates, a current resume, copies of any state teaching licenses or professional certifications, and a signed offer letter detailing your role and salary. Foreign credentials usually require a NACES evaluation. USCIS also requires the employer to file an LCA with DOL certifying the prevailing wage before submitting the full I-129 petition.
