Get Access To All JobsTips for Finding H-1B Visa Sponsorship in Student Advisor
Verify your degree meets specialty occupation
USCIS requires your bachelor's degree field to directly relate to student advising work. A degree in counseling, higher education, psychology, or social work satisfies this. An unrelated degree paired with advisory experience alone is unlikely to hold up under an RFE.
Target institutions with cap-exempt status
Universities, nonprofit research organizations, and government-affiliated colleges are cap-exempt H-1B employers. Applying there lets you start any time of year without waiting for the April lottery, which is a real advantage for Student Advisor roles with academic-year hiring cycles.
Search LCA filings before applying
Use Migrate Mate to filter Student Advisor openings by verified LCA filing history, so you're targeting employers who have actually sponsored this role before, not just ones who mention sponsorship in a job posting.
Check prevailing wage before salary negotiations
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your location and job title. Run the OFLC Wage Search using SOC code 21-1012 before your offer stage so you know the wage floor and can negotiate above it with confidence.
Confirm O*NET classification with your hiring manager
The O*NET profile for Student Advisors lists a bachelor's degree as the typical entry-level requirement, which supports the specialty occupation argument. Ask HR whether they'll use SOC 21-1012 or a related code on the LCA, since misclassification is a common cause of I-129 RFEs.
Time your offer letter around the H-1B cap deadline
Cap-subject H-1B registrations open in March for an April lottery. Your employer needs your signed offer letter and basic credentials before submitting your registration. Waiting until after a lottery announcement to secure an offer leaves no time for USCIS filing prep.

Find Student Advisor JobsStudent Advisor H-1B Visa: Frequently Asked Questions
Does a Student Advisor role qualify as an H-1B specialty occupation?
Yes, provided the position requires at least a bachelor's degree in a directly related field such as counseling, higher education administration, psychology, or social work. The key is that the employer's job description must list a specific degree requirement, not just a preference. USCIS has issued RFEs on Student Advisor petitions where the role was posted as open to any bachelor's degree, so specificity in the job posting matters.
Which types of employers sponsor H-1B visas for Student Advisors?
Universities and community colleges are the most consistent sponsors because they're cap-exempt, meaning they can file H-1B petitions year-round without the lottery. EdTech companies, tutoring platforms, and nonprofit educational organizations also sponsor this title but are generally cap-subject. You can browse Student Advisor openings filtered by sponsorship history on Migrate Mate.
What happens to my H-1B status if my advising contract ends before the visa expires?
You have a 60-day grace period from your last day of employment to find a new H-1B sponsor, change to another visa status, or depart the U.S. During this window you can't work, but you're not accruing unlawful presence. Starting your job search immediately is critical since H-1B transfers require the new employer to file before your grace period ends.
Can a Student Advisor role at a university bypass the H-1B lottery?
Yes. Colleges and universities that are accredited and operate as nonprofits qualify as cap-exempt H-1B employers under the INA. That means your employer can file your H-1B petition at any time of year, and you can start work as soon as USCIS approves the petition. This is one of the clearest structural advantages of pursuing Student Advisor roles in higher education over the private sector.
What SOC code applies to Student Advisors for the H-1B LCA?
Most H-1B petitions for Student Advisor roles use SOC code 21-1012, Educational, Guidance, and Career Counselors and Advisors. You can review the occupation's typical education requirements and tasks in the O*NET profile, which USCIS adjudicators reference when evaluating specialty occupation claims. Confirm with your employer's attorney that the LCA uses this code before the petition is filed.
