Verify your degree field matches the role
H-1B approval for paraprofessional roles hinges on specialty occupation status. Your degree must be in special education, psychology, or a directly related field. A general education or unrelated degree creates RFE risk before you even apply.
Target districts with prior LCA filings
Use OFLC Wage Search to find school districts that have filed Labor Condition Applications for paraprofessional or instructional aide roles. Districts with prior filings have already cleared the internal HR and legal approval process, reducing your sponsorship timeline risk.
Request your offer letter before the April deadline
H-1B cap filings open in March with an April 1 filing deadline. Your employer must submit your petition by then. Secure a written offer letter and confirm your district's legal counsel is ready to file before the registration window closes.
Check if your district is cap-exempt
Paraprofessionals hired by nonprofits affiliated with universities or government research institutions may qualify for cap-exempt H-1B status. USCIS allows cap-exempt petitions year-round with no lottery, so ask HR whether your employer qualifies before assuming lottery entry is required.
Search H-1B sponsoring employers on Migrate Mate
Pull up Special Education Paraprofessional listings on Migrate Mate to see which employers have verified H-1B filing history for this role. That filters out districts that post jobs but don't actually sponsor, saving you weeks of dead-end outreach.
Document your state teaching credential before filing
Many states require paraprofessionals to hold a paraeducator license or pass a state competency assessment. USCIS may request proof your credentials meet state law as part of the specialty occupation determination, so gather those documents before the petition is submitted.
H-1B Visa Special Education Paraprofessional: Frequently Asked Questions
Does a Special Education Paraprofessional role qualify as a specialty occupation for H-1B purposes?
It depends on how the employer defines the position. If the job description requires at minimum a bachelor's degree in special education, psychology, applied behavior analysis, or a closely related field, USCIS will typically consider it a specialty occupation. Roles framed as general aide positions without a specific degree requirement are harder to support and frequently trigger Requests for Evidence.
Which types of employers sponsor H-1B visas for this role?
Public school districts, charter school networks, and nonprofit learning centers are the most common sponsors. Some districts work with centralized legal counsel who handle petitions across multiple schools, which speeds up the process. Use Migrate Mate to find employers with documented H-1B filing history for Special Education Paraprofessional or closely matched job titles before you invest time applying.
Does a foreign special education degree meet USCIS requirements?
A foreign bachelor's degree in special education or a related field is generally acceptable if evaluated as equivalent to a U.S. four-year degree. You'll need a credential evaluation from a NACES-member organization. USCIS reviews the evaluation as part of the petition, and your degree field must align with the paraprofessional duties described in the job offer.
Can a school district sponsor an H-1B and still require a state paraeducator credential?
Yes. Your employer can file the H-1B petition while you hold or are in the process of obtaining a state paraeducator license or certification. However, some states require the credential before you can be employed in the role, so timing matters. Confirm with your district's HR team which credentials must be in place before your start date.
What happens to my H-1B if my school district eliminates my position mid-year?
If your employer terminates your position, your H-1B status ends and the 60-day grace period begins. Your employer is also responsible for the cost of returning you to your home country. You can use the 60-day window to find a new sponsoring employer and file an H-1B transfer. Timely action is critical because your work authorization does not extend beyond that window.
