Verify your degree meets specialty occupation
USCIS requires a direct connection between your bachelor's degree field and the paraprofessional role. A degree in education, child development, or psychology typically satisfies this. A general studies degree often doesn't, so document the field-to-role link clearly before applying.
Target districts with active LCA filing history
Public school districts file Labor Condition Applications through DOL before petitioning USCIS. Search OFLC Wage Search filtering by education sector to identify districts that have sponsored paraprofessionals before. Prior filings signal an established HR process, not just willingness.
Use Migrate Mate to filter verified sponsors
Search Migrate Mate to find paraprofessional openings specifically at employers with H-1B LCA filing history in education roles. This filters out listings from districts that have never filed, saving you from offers that stall at HR.
Clarify role classification before offer stage
Ask hiring managers whether the position is classified under SOC code 25-9040 or a related education support code. Misclassification at the LCA stage is a common reason paraprofessional petitions get delayed or denied, and you can flag it early.
Request premium processing if your start date is fixed
School-year start dates are rigid. If your offer is contingent on being authorized by August or September, ask your employer to file with USCIS premium processing. Standard H-1B processing can exceed four months, which misses most district onboarding windows.
Gather state licensure documents before your LCA is filed
Several states require paraprofessionals to hold an educator or paraprofessional certification. Your employer's LCA must reflect any state-mandated requirements for the role, so confirm licensing requirements with the state education board before the petition is drafted.
H-1B Visa Paraprofessional: Frequently Asked Questions
Do paraprofessional jobs qualify for H-1B sponsorship?
Paraprofessionals can qualify for H-1B sponsorship if the specific position requires a bachelor's degree or higher in a directly related field such as education, special education, or psychology. Roles that accept any bachelor's degree or that don't mandate a degree at all typically fail the specialty occupation standard USCIS applies. The job description and employer documentation matter significantly.
Which types of employers sponsor H-1B visas for paraprofessionals?
Charter school networks, private special education schools, and large urban public school districts are the most consistent sponsors. Nonprofit educational organizations and early intervention service providers also file LCAs for paraprofessional roles. You can find employers with verified H-1B filing history in this field by searching Migrate Mate, which filters listings by employers with active LCA records.
How does the prevailing wage requirement affect paraprofessional H-1B petitions?
Your employer must pay at least the DOL prevailing wage for the paraprofessional role in the specific geographic area where you'll work. You can look up applicable wage levels using the OFLC Wage Search tool. School districts sometimes structure paraprofessional pay on salary schedules that fall below Level I prevailing wage, which blocks the LCA certification and must be corrected before USCIS filing.
Does the O*NET classification for paraprofessionals affect my H-1B petition?
O*NET classifies paraprofessors under codes like 25-9040, with job zone ratings that inform USCIS adjudicators reviewing specialty occupation claims. Because paraprofessional roles historically show variability in degree requirements across districts, the O*NET profile can be used by both petitioners and USCIS to argue for or against specialty occupation status, making the employer's position description critically important.
Can I transfer my H-1B to a new school district without starting over?
Yes, H-1B portability under AC21 lets you transfer to a new sponsoring employer once your petition has been approved and you've maintained valid status. Your new district must file a new LCA and H-1B transfer petition before or when you start. The 60-day grace period after your prior employment ends gives you time to arrange the transfer without an authorization gap.
