Verify your degree meets specialty occupation
H-1B approval for teaching roles hinges on a direct link between your degree field and the subject you'll teach. A general education degree supporting a specialized subject-matter role can trigger an RFE, so align your credential documentation precisely to the job description.
Target cap-exempt employers first
Universities, nonprofit research institutions, and government-affiliated schools are cap-exempt under USCIS rules, letting you start any time without waiting for the April lottery window. Filter your job search to these institution types to avoid the October 1 start-date constraint.
Check prevailing wage before accepting an offer
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your teaching role and location. Run the OFLC Wage Search using the correct SOC code for your subject area before negotiating salary so you know the floor.
Use Migrate Mate to find verified sponsoring schools
Search Migrate Mate to identify schools and universities with confirmed H-1B LCA filing history in teaching roles. This surfaces employers already familiar with the process, reducing the risk of an offer falling through over sponsorship uncertainty.
Request your I-129 filing timeline from the employer
Cap-subject teaching roles must have an I-129 filed with USCIS for an October 1 start, meaning your offer must come by spring. Confirm the school's HR and legal team understand this deadline before you resign from a current position.
Get your foreign credentials evaluated early
If you earned your teaching degree outside the U.S., a credential evaluation from a NACES-member organization is typically required for both state licensure and the USCIS specialty occupation determination. Delays in evaluation can stall the entire petition timeline.
H-1B Visa Teaching: Frequently Asked Questions
Do all teaching jobs qualify for H-1B sponsorship?
Not automatically. USCIS requires the role to meet the specialty occupation standard, meaning a bachelor's degree or higher in a specifically related field is a normal requirement for the position. Subject-specific teaching roles in STEM, foreign languages, and higher education typically qualify more easily than general K-12 classroom positions, where the degree requirement can be harder to establish.
Are university and school teaching jobs subject to the H-1B lottery?
Many are not. Public and private universities, nonprofit research institutions, and schools affiliated with government entities are cap-exempt, so petitions can be filed at any point in the year without entering the annual H-1B lottery. K-12 public school districts are often cap-subject, though some qualify for cap-exemption through university partnerships. Confirm the institution's cap status before accepting an offer.
How do I find teaching employers that actively sponsor H-1B visas?
Search Migrate Mate to browse teaching roles at employers with verified H-1B LCA filing history. Focusing on institutions that have filed Labor Condition Applications for teaching positions in the past gives you a much stronger signal of genuine sponsorship willingness than simply asking HR during an interview.
What role does state teacher licensure play in the H-1B process?
State licensure is separate from USCIS approval but closely linked in practice. Many states require a valid teaching license before a school can extend a formal offer, and some license applications require an active visa status or employment authorization. Start the licensure process as early as possible, since delays can push back your I-129 filing and jeopardize an October 1 start date for cap-subject roles.
Can I switch to a different school while on H-1B status?
Yes, but the new school must file an H-1B transfer petition with USCIS before or on your first day of employment. Portability rules under AC21 allow you to start working for the new employer once the transfer petition is filed, as long as your previous H-1B was approved and you've been in valid status. Don't resign from your current position until the transfer petition has been submitted.
