Verify your credentials meet specialty occupation
USCIS requires that nursing instructor roles demand a specific bachelor's degree, not just any degree. An MSN or BSN with clinical teaching experience strengthens the specialty occupation argument. Have your credential evaluation done before applying.
Target institutions with active LCA filing history
Use Migrate Mate to filter nursing instructor roles by employers who have filed LCAs under SOC 25-1072. This tells you which schools and health systems have already cleared the DOL prevailing-wage process for this exact title.
Check prevailing wage before negotiating your offer
Run your target job location through the OFLC Wage Search before salary talks. The DOL sets four wage levels for nursing instructors by region. Your offer must meet at least Level I or your employer's LCA will be rejected.
Ask whether the school is cap-exempt
Many colleges and universities qualify as cap-exempt H-1B employers, meaning you avoid the lottery entirely. Confirm this with the hiring department before accepting an offer. Cap-exempt status lets you start at any time of year.
Align your clinical licensure with the state before filing
USCIS often requests proof that you hold a valid RN license in the state where you'll teach. Compact license states simplify this, but non-compact states require a separate application. Get licensure in progress before your employer files the I-129.
Build a teaching portfolio that maps to O*NET
The O*NET profile for postsecondary nursing instructors lists specific competencies USCIS reviewers reference during adjudication. Organize your CV around those tasks: curriculum design, clinical supervision, and assessment development reduce RFE risk.
H-1B Visa Nursing Instructor: Frequently Asked Questions
Do nursing instructor jobs qualify for H-1B sponsorship?
Yes. Postsecondary nursing instructor roles qualify as H-1B specialty occupations because they require at minimum a bachelor's degree in nursing or a closely related field. Most full-time positions at community colleges, universities, and hospital-based schools of nursing meet USCIS's specialty occupation standard, especially when the role involves curriculum development or clinical supervision.
Which types of employers sponsor H-1B visas for nursing instructors?
Universities, community colleges, and hospital-affiliated nursing programs are the most common H-1B sponsors for this role. Many accredited colleges and universities qualify as cap-exempt employers, which means they can file H-1B petitions outside the annual lottery. Use Migrate Mate to browse nursing instructor openings filtered by employers with verified LCA filing history.
Does a nursing instructor need an active RN license to get H-1B sponsorship?
In most cases, yes. USCIS and the hiring institution typically require that a nursing instructor hold a valid RN license in the state where the role is based, particularly for positions involving hands-on clinical instruction. If you're moving from a compact-license state to a non-compact state, start the endorsement process before your employer files the I-129 petition.
What is the DOL prevailing wage for nursing instructor H-1B positions?
The DOL sets prevailing wages for nursing instructors under SOC code 25-1072, and the rate varies by geographic area and experience level. Your employer must pay at least the DOL-determined wage for your location and job level before USCIS will approve the petition. Run your target location through the OFLC Wage Search to see the applicable wage level before negotiating your offer.
Can a nursing instructor be sponsored for a green card while on H-1B?
Yes. Nursing instructors sponsored by colleges and universities can often pursue EB-2 or EB-3 green card sponsorship while maintaining H-1B status. Some tenured or tenure-track faculty roles at universities may qualify for the EB-1B outstanding researcher category. Your employer's immigration counsel would manage the PERM labor certification process if the EB-2 or EB-3 route is used.
