Verify your institution's cap-exempt status
Many universities and affiliated research hospitals qualify as cap-exempt H-1B employers, meaning USCIS can approve your petition at any time of year. Confirm this status directly with HR before accepting an offer, since it affects your start date flexibility.
Align your degree field to the advertised role
USCIS scrutinizes whether your specific degree discipline matches the professorship's subject area. A PhD in economics supporting a finance lecturer role may draw a Request for Evidence. Get written confirmation from the department chair that your field qualifies before filing.
Search employer LCA filing history on Migrate Mate
Use Migrate Mate to filter institutions by their Labor Condition Application filing history for professor-level roles. This shows which colleges have actively sponsored H-1B faculty recently, so you target employers with a real track record rather than guessing.
Request prevailing wage documentation before negotiating
Your employer must certify a wage meeting DOL prevailing wage levels on your LCA. Look up the Level II or III wage for your occupation code and metro area using the OFLC Wage Search before your offer conversation, so you know the compliance floor.
Submit credentials for foreign degree equivalency early
If your terminal degree is from outside the U.S., get a credential evaluation from a NACES-member organization before the department submits the I-129. USCIS routinely questions whether a three-year international doctorate meets U.S. equivalency standards for specialty occupation classification.
Confirm the offer covers H-1B attorney and filing fees
Federal law prohibits employers from passing certain mandatory H-1B filing fees to you as the beneficiary. Before signing your faculty offer letter, verify in writing that the institution covers I-129 filing fees, as violations can jeopardize your petition.

Find Assistant Or Associate Professor JobsAssistant Or Associate Professor H-1B Visa: Frequently Asked Questions
Do assistant and associate professor jobs qualify as H-1B specialty occupations?
Yes. USCIS classifies postsecondary teaching positions as specialty occupations because they normally require at least a master's degree or the equivalent in the specific academic discipline. The O*NET profile for postsecondary teachers confirms the degree requirement, and universities routinely file H-1B petitions for faculty at both the assistant and associate level.
Can universities sponsor H-1B visas outside the annual cap and lottery?
Many can. Universities, nonprofit research organizations, and government research entities are cap-exempt under USCIS rules, meaning petitions they file are not subject to the 85,000-slot annual cap or the registration lottery. This lets qualifying institutions hire H-1B faculty at any point in the year, which is a significant practical advantage over for-profit employers.
How do I find colleges and universities actively sponsoring H-1B visas for faculty roles?
Search Migrate Mate to browse professor-level positions at institutions with verified H-1B LCA filing history. This filters out postings from employers who have never filed for faculty roles and surfaces schools that have a real track record of sponsoring international academics, saving you time during the application process.
Does my foreign PhD count as the equivalent of a U.S. doctoral degree for H-1B purposes?
Generally yes, but USCIS requires documentation. A credential evaluation from a NACES-member organization translates your degree into U.S. equivalency terms and becomes part of the I-129 supporting evidence. A three-year international doctorate is usually accepted, but the specific institution and program matter, so get the evaluation before your employer files.
What happens to my H-1B status if I move from assistant to associate professor at the same institution?
A promotion within the same university typically requires an amended H-1B petition if the job duties, title, or wage level change materially. Your employer files an I-129 amendment with USCIS before the change takes effect. In most cases you can begin the new role while the amendment is pending, but confirm this with your institution's international office.
