Target cap-exempt institutions first
Colleges, universities, and nonprofit research organizations affiliated with higher education can file H-1B petitions outside the annual cap. That means year-round filing, no lottery, and a faster path to approval than corporate sponsors.
Confirm your field maps to a specialty occupation
USCIS requires that an Adjunct Faculty role normally requires a bachelor's degree in a specific discipline. Pull the O*NET occupation profile for your teaching field to document the standard educational requirement before your employer files.
Request the LCA before negotiating your contract
Your employer must file a Labor Condition Application with DOL and certify it before submitting the H-1B petition. Ask HR to initiate the LCA early, since adjunct contracts are often finalized weeks before a semester starts, leaving little time.
Search Migrate Mate for adjunct roles with filing history
Use Migrate Mate to filter Adjunct Faculty openings by employers with verified H-1B LCA filing history. That lets you focus your applications on institutions that have already sponsored the role, not ones that might sponsor it in theory.
Verify prevailing wage against your offer letter
DOL requires your offered wage to meet the prevailing wage for your occupation and location. Run your job title and zip code through the OFLC Wage Search before signing any contract to confirm your rate meets the requirement.
Clarify part-time status with your petitioning employer
USCIS allows H-1B petitions for part-time adjunct positions, but the approved hours and wage must match what the employer files. If your course load changes semester to semester, your employer may need to amend the petition to avoid a status violation.
H-1B Visa Adjunct Faculty: Frequently Asked Questions
Can an adjunct faculty position qualify for H-1B sponsorship?
Yes. An Adjunct Faculty role qualifies when the institution requires a bachelor's degree or higher in a specific academic discipline for the position. USCIS evaluates the job's theoretical and practical application of specialized knowledge, not just the job title. Roles that accept any degree field or treat the degree as optional are harder to approve.
Do I need to go through the H-1B lottery for a university adjunct role?
Not necessarily. Colleges, universities, and affiliated nonprofit research institutions are cap-exempt employers under the Immigration and Nationality Act. That means they can file H-1B petitions at any time of year without waiting for the April lottery or the October 1 start date. Confirm your specific institution's cap-exempt status with HR before assuming this applies.
How do I find adjunct faculty employers who actively sponsor H-1B visas?
Migrate Mate surfaces Adjunct Faculty openings filtered by employers with verified H-1B LCA filing history from DOL disclosure data. That lets you focus on institutions that have sponsored the role before rather than contacting departments that have no experience with the H-1B process.
What happens to my H-1B status if my course load is reduced mid-semester?
If your approved hours drop significantly below what USCIS certified in your H-1B petition, your employer needs to file an amended petition reflecting the change. Working fewer hours than petitioned without an amendment can create a status violation. Adjuncts on per-course contracts should confirm with HR what triggers an amendment requirement before accepting a reduced load.
Can I teach at more than one institution on a single H-1B visa?
You can work for multiple cap-exempt institutions simultaneously, but each employer must file a separate H-1B petition. USCIS requires a concurrent H-1B approval from every institution paying you as an adjunct. Don't start teaching at a second school while waiting on their petition approval, even if both are cap-exempt.
