Verify your state teaching license transfers
Your home-country teaching credential doesn't automatically satisfy U.S. state licensure requirements. Contact your target state's Department of Education before accepting an offer, some states require additional coursework or exams before a petition can be filed.
Target cap-exempt employers first
Universities, community colleges, and nonprofits affiliated with higher education are cap-exempt, meaning they can file your H-1B petition any time of year without entering the lottery. Math instructors at these institutions skip the April cap season entirely.
Get your foreign degree evaluated early
USCIS requires a credential evaluation from a NACES-member organization to confirm your degree is equivalent to a U.S. bachelor's in mathematics or mathematics education. Order this before your job search so employers see a complete package from day one.
Search verified H-1B sponsors on Migrate Mate
Filter by education employers with active H-1B filing history on Migrate Mate. You'll see which school districts and private institutions have sponsored Math Teacher roles using DOL Labor Condition Application data, so you don't waste time on employers who've never filed.
Confirm your employer's prevailing wage tier
Your offered salary must meet the DOL prevailing wage for your SOC code and school district's location. Use the OFLC Wage Search to look up the Level I through Level IV wage range for your role before negotiating, so you know the floor your employer must meet.
Ask about the LCA timeline before signing
Your employer must file a certified Labor Condition Application with DOL before USCIS can receive your I-129 petition. Confirm the district has designated HR staff or an immigration attorney to handle this, school districts without prior experience often underestimate the lead time required.
H-1B Visa Math Teacher: Frequently Asked Questions
Does a Math Teacher role qualify as a specialty occupation for H-1B purposes?
Yes. USCIS classifies Math Teacher as a specialty occupation because the role normally requires at least a bachelor's degree in mathematics, mathematics education, or a closely related field. You'll need to show your job description explicitly requires that degree, not just prefers it. The O*NET profile for secondary school teachers supports this classification and is frequently cited in petitions.
Can a public school district sponsor an H-1B visa for a math teacher?
Public school districts can sponsor H-1B visas, but they are generally cap-subject employers, meaning your petition enters the annual lottery held each April. If you're targeting a public district, your employer needs to file during the registration window in March for an October 1 start date. Some districts affiliated with a university or nonprofit may qualify for cap-exempt status, confirm this with HR before the school year hiring cycle begins.
How do I find school districts and private schools that have sponsored H-1B visas before?
Migrate Mate filters employers by verified H-1B filing history using DOL Labor Condition Application data, so you can identify which school districts, charter networks, and private institutions have actively sponsored Math Teacher roles. This is more reliable than asking HR cold, since many districts have sponsored before but don't advertise it in job postings.
Does my foreign teaching degree satisfy H-1B educational requirements?
It can, but USCIS requires a credential evaluation from a NACES-member organization confirming your degree is equivalent to a U.S. bachelor's degree in a relevant field. A three-year bachelor's from certain countries may or may not meet this threshold depending on the evaluator's assessment. Get the evaluation done before your job search so it's ready when an employer asks.
What happens to my H-1B status if the school district doesn't rehire me for the next school year?
If your employment ends, you have a 60-day grace period to find a new sponsoring employer, change to another visa status, or depart the U.S. Your new employer must file a transfer petition before your grace period expires to maintain continuous status. During the summer break between school years, your status depends on whether your contract covers that period, confirm this in writing with your employer before the academic year ends.
