Align your resume to SOC codes
GenAI Engineer roles are typically filed under SOC 15-1252 (Software Developers) or 15-2051 (Data Scientists). Match your resume's job titles and skill descriptions to the SOC code your target employer will use when certifying your prevailing wage with DOL.
Verify prevailing wage tier before negotiating
Use the OFLC Wage Search to look up the Level I through Level IV wage for your target SOC code and work location before any offer conversation. Knowing the certified wage floor protects you from offers that won't survive USCIS scrutiny.
Target employers with LCA history in AI roles
Search Migrate Mate to filter employers by H-1B filing history specifically in AI and machine learning job titles. Companies that have certified LCAs for GenAI roles before understand the specialty occupation documentation requirements and move faster through the process.
Document your model architecture contributions
USCIS RFEs for software roles increasingly challenge whether the position truly requires a specific degree. Build a work portfolio showing your direct contributions to LLM fine-tuning, RAG pipelines, or model evaluation frameworks to support the specialty occupation determination.
Confirm E-Verify enrollment before cap-gap reliance
If you're transitioning from F-1 OPT to H-1B status and relying on the cap-gap extension, your employer must be enrolled in E-Verify. An employer that isn't enrolled can't legally employ you during the cap-gap period even with a timely-filed petition.
Request premium processing at petition filing
GenAI roles attract scrutiny under specialty occupation standards. Premium processing gets USCIS to issue a decision within 15 business days, so you learn quickly whether an RFE is coming rather than waiting months during standard adjudication.

Find Genai Engineer JobsGenai Engineer H-1B Visa: Frequently Asked Questions
Does a GenAI Engineer role qualify as a specialty occupation for H-1B purposes?
Yes, provided the position requires at least a bachelor's degree in a directly related field such as computer science, machine learning, or applied mathematics. USCIS looks at whether the degree requirement is standard for entry into the occupation, so your employer's job description must specify the degree field, not just list it as preferred.
Which SOC code do employers typically use when filing H-1B petitions for GenAI Engineers?
Most employers file under SOC 15-1252 (Software Developers) or SOC 15-2051 (Data Scientists), depending on whether the role centers on building AI-powered applications or developing and evaluating models. The SOC code determines which prevailing wage level DOL certifies, so confirm with your employer which code they plan to use before the LCA is submitted.
How do I find employers actively sponsoring H-1B visas for GenAI Engineer roles?
Migrate Mate surfaces employers with verified H-1B LCA filing history filtered by AI and machine learning job titles, so you can identify companies that have already navigated the specialty occupation certification process for roles like yours. This is more reliable than guessing from general company reputation, since actual DOL filings confirm sponsorship willingness.
Can I change employers mid-H-1B if a better GenAI role comes along?
Yes. Under H-1B portability rules, you can start working for a new employer as soon as they file a new H-1B petition on your behalf, as long as your previous status was lawfully maintained. The new employer must file a fresh LCA with DOL certified for the new role and work location before USCIS can adjudicate the transfer petition.
What documentation strengthens an H-1B petition for a GenAI Engineer position?
The employer's support letter must explain why the specific role requires a degree in a directly related field, not just a general technology background. Supporting evidence that helps includes O*NET job zone data for the occupation, internal job postings that list degree requirements, and your own work samples showing work that requires specialized knowledge, such as model training pipelines or RAG architecture design documents.
