District Attorney Jobs for OPT Students
District Attorney jobs involve prosecuting criminal cases on behalf of the government, requiring a J.D. and state bar admission. F-1 OPT students who graduated from U.S. law schools may qualify if they pass the bar, but government employer hiring timelines and OPT authorization windows require careful planning.

How to Get Visa Sponsorship as a District Attorney
Verify bar admission before applying
Most District Attorney offices require active state bar admission before you can be hired. Check each jurisdiction's bar eligibility rules for foreign nationals early, since bar exam timing directly affects whether you can start within your OPT window.
Apply during your third year of law school
DA offices often recruit in the fall of your final law school year for positions starting after graduation. Applying early gives you the best shot at aligning a government hiring timeline with your OPT authorization start date.
Target jurisdictions with faster bar results
Some states release bar results faster than others, which matters when your OPT window is limited. Prioritize jurisdictions where you can sit, receive results, and get sworn in before your authorized employment period expires.
Request a deferred start date tied to bar results
Many DA offices will negotiate a conditional start date pending bar passage. Frame this request professionally during the offer stage, and confirm that your STEM or standard OPT period still covers your anticipated bar admission date.
Highlight law school clinic and internship experience prominently
DA offices prioritize candidates with hands-on courtroom exposure. Prosecution clinics, externships with U.S. Attorney offices, and criminal defense experience all signal trial readiness and help offset any concerns about hiring a candidate on OPT.

Get Access To All JobsFrequently Asked Questions
Can F-1 OPT students work as a District Attorney?
Yes, but bar admission is the main gate. You need to pass the state bar in the jurisdiction where the DA office operates before you can be hired as a practicing attorney. Your J.D. from a U.S. accredited law school satisfies the educational requirement, but timing your bar exam results and OPT authorization to overlap is critical.
Do District Attorney offices sponsor H-1B visas for OPT students?
Most do not. Government DA offices are county or state entities that generally lack the infrastructure or legal authority to file H-1B petitions. A small number of offices affiliated with cap-exempt organizations may have pathways, but this is rare. You should discuss your post-OPT immigration options with an attorney before accepting an offer from a DA office.
Does a J.D. qualify as a STEM degree for the 24-month STEM OPT extension?
No. A J.D. is not classified under a STEM-designated CIP code, so law graduates are not eligible for the 24-month STEM OPT extension. Standard OPT provides 12 months of work authorization. Planning your bar exam timeline, hiring process, and any future visa transition around that 12-month window is essential for District Attorney roles.
Where can I find District Attorney job postings that are open to OPT students?
Migrate Mate lists government and public sector legal positions where employers are open to hiring candidates on OPT. Searching Migrate Mate is a practical starting point because it filters for sponsorship context, saving you time compared to reviewing individual county or state government job portals that rarely specify OPT-friendliness in their postings.
What happens if my OPT expires before bar results are released?
If your OPT authorization expires before you receive bar results and begin employment, you lose work authorization and cannot legally start the job. Options include filing for a timely change of status before OPT ends, applying to the bar earlier to compress the timeline, or negotiating a conditional offer in a state with faster result turnaround. Consult your DSO well in advance.
