Target law firms with international clients
BigLaw firms like Skadden, Latham & Watkins, and Sullivan & Cromwell regularly sponsor foreign attorneys. Their international client base creates consistent demand for attorneys with cross-border expertise and foreign law backgrounds.
Emphasize specialized practice areas
Focus on high-demand specializations like securities law, M&A, banking regulation, or international transactions. USCIS views specialized corporate law practice as requiring specific legal expertise that supports H-1B specialty occupation requirements.
Consider in-house counsel positions
Multinational corporations frequently sponsor corporate attorneys for in-house roles. Companies like Google, JPMorgan, and Microsoft have dedicated immigration teams and established processes for sponsoring legal talent with specialized corporate law experience.
Highlight cross-border transaction experience
Experience with international deals, foreign investment regulations, or multi-jurisdictional compliance strengthens your sponsorship case. Employers value attorneys who can navigate complex cross-border legal requirements and regulatory frameworks across multiple countries.
Network through legal associations
Join American Bar Association sections, International Bar Association, and local bar associations. Many sponsoring employers recruit through legal networks, continuing education events, and bar association job boards targeting international legal talent.
Consider EB-1A for senior attorneys
Partners or senior attorneys with significant achievements may qualify for EB-1A extraordinary ability petitions. Published articles, speaking engagements, bar leadership positions, and major deal recognition can support exceptional ability claims in corporate law.
Frequently Asked Questions
Do I need a J.D. from a U.S. law school for H-1B sponsorship as a corporate attorney?
No, but you need equivalent qualifications. Foreign law degrees typically require credential evaluation showing U.S. equivalency, plus admission to a U.S. state bar or qualification to practice under state rules. Many corporate attorneys with foreign law degrees receive H-1B visa approval after passing the bar exam.
Which visa category is better for corporate attorneys: H-1B or O-1?
H-1B is more common for most corporate attorney positions since the role clearly qualifies as a specialty occupation. O-1 visa requires extraordinary ability evidence like major deal recognition, published legal scholarship, or partnership at prestigious firms. Most entry-level and mid-level corporate attorneys pursue H-1B first.
What approval rates do corporate attorneys see for H-1B petitions?
Corporate attorney H-1B petitions have strong approval rates, typically above 85%, because the role clearly requires specialized legal knowledge. Denials usually stem from credential evaluation issues or employers failing to demonstrate the position requires a J.D. rather than the attorney's qualifications themselves.
Can corporate attorneys change employers while on H-1B status?
Yes, through H-1B portability rules. You can start working for the new employer immediately after they file your transfer petition, without waiting for approval. Corporate law positions at different firms or in-house counsel roles typically qualify as similar positions for transfer purposes.
How to find Corporate Attorney jobs with visa sponsorship?
To find Corporate Attorney jobs with visa sponsorship, use Migrate Mate, which specializes in sponsored legal positions. Focus on H-1B and O-1 visa opportunities at multinational corporations, investment banks, tech companies, and Big Law firms. These employers frequently sponsor qualified international attorneys for corporate law, mergers and acquisitions, securities, and compliance roles.
Do boutique corporate law firms sponsor H-1B visas as often as BigLaw firms?
Boutique firms sponsor less frequently due to cost and complexity concerns, but many do sponsor for specialized expertise they cannot find domestically. Smaller firms often prefer candidates who bring unique skills like specific foreign law knowledge, language abilities, or experience with particular international markets.
What is the prevailing wage requirement for sponsored Corporate Attorney jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
