How to Get Visa Sponsorship in Senior Product Counsel
Target tech companies with legal teams
Large technology employers file LCAs for Senior Product Counsel positions regularly. Their in-house legal departments have established immigration processes, making sponsorship faster and less uncertain than at companies sponsoring their first legal hire.
Confirm your bar admission transfers
Employers will verify your bar status before filing a visa petition. If you're admitted in one state but the role is in another, confirm whether the employer requires local bar admission or accepts admission in any U.S. jurisdiction.
Understand the specialty occupation argument
USCIS scrutinizes legal roles carefully. Your petition should demonstrate the position requires a law degree specifically, not just a general bachelor's degree. Document the JD requirement explicitly in the offer letter and job description.
Ask about cap-exempt employers
Universities, nonprofit research organizations, and certain government contractors are exempt from the H-1B lottery. If you've lost the lottery before, in-house counsel roles at cap-exempt institutions are worth targeting to secure status without lottery risk.
Leverage O-1A if you have a strong profile
Senior Product Counsel with published work, speaking credits, leadership roles in legal organizations, or high-profile transactions may qualify for the O-1A extraordinary ability visa, which has no lottery and no annual cap.

Get Access To All JobsFrequently Asked Questions
Is Senior Product Counsel a qualifying specialty occupation for the H-1B visa?
Yes, Senior Product Counsel qualifies as a specialty occupation because the role requires a Juris Doctor as a minimum entry requirement, which satisfies the degree-specific standard USCIS applies. The JD must be tied directly to the legal work performed, not just listed as a preference. Employers should make the degree requirement unambiguous in the job description and offer letter to avoid a Request for Evidence.
Do I need to be licensed to practice law in the U.S. to get sponsored for this role?
Most employers require active bar admission in at least one U.S. state for a Senior Product Counsel position, and some require admission in the state where the role is based. Foreign-licensed attorneys are generally not eligible for in-house counsel roles unless they also hold a U.S. LLM and have passed a state bar exam. Confirm bar requirements with each employer during the interview process before discussing sponsorship.
Where can I find Senior Product Counsel jobs that offer visa sponsorship?
Migrate Mate lists Senior Product Counsel openings filtered by visa sponsorship availability, so you're not applying to roles that won't support your visa status. Most sponsoring employers in this category are mid-to-large technology companies with dedicated legal and immigration infrastructure. Browsing by sponsorship type on Migrate Mate also lets you identify which employers are actively filing LCAs for legal roles.
What visa options exist for Senior Product Counsel beyond the H-1B?
The O-1A is a strong alternative for attorneys with an exceptional record, including high-profile transactions, published legal analysis, or leadership in bar associations. Australians with a U.S.-recognized law degree and bar admission can pursue the E-3, which has no lottery. L-1 transfers apply if you're moving from a foreign office of the same company to a U.S. in-house legal role.
How does having a foreign law degree affect my sponsorship eligibility?
A foreign law degree alone is generally insufficient for U.S. in-house counsel positions. Most employers and state bar requirements expect either a U.S. JD or a U.S. LLM combined with passing a state bar exam. If you hold a foreign LLB or equivalent, you'll need a credential evaluation confirming equivalency and should verify bar eligibility in the target state before applying, since bar admission is typically a hard requirement for sponsorship.
What is the prevailing wage requirement for sponsored Senior Product Counsel jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
