Lead with both technical and leadership credentials
Hiring managers and immigration attorneys need to justify specialty occupation status for management roles. Highlight your engineering background alongside team leadership scope, headcount managed, systems owned, and measurable engineering outcomes strengthen the petition considerably.
Prioritize employers with active H-1B filing history
Not every company that posts a senior engineering management role will sponsor visas. Focus on employers who have filed H-1B petitions in recent years, this signals an established immigration infrastructure and legal counsel already familiar with the process.
Understand the L-1A pathway if you're transferring internally
If your current employer has a U.S. office, an L-1A intracompany transfer can be faster than H-1B and bypasses the lottery entirely. You'll need at least one year of managerial or executive experience with the company abroad in the past three years.
Document your team's organizational structure clearly
USCIS scrutinizes L-1A and EB-1C petitions heavily for managerial capacity. An org chart showing direct reports, their roles, and how your function fits the broader engineering organization is evidence you'll want prepared well before any petition is filed.
A master's degree significantly strengthens your position
While a bachelor's in computer science typically satisfies specialty occupation requirements, a master's or MBA reduces RFE risk for senior management roles where USCIS may question whether a degree is strictly required for the specific position.
Start the sponsorship conversation before accepting an offer
Senior engineering management roles have longer hiring timelines and more stakeholders involved in the offer stage. Raising visa sponsorship requirements during initial recruiter screens avoids wasted time and ensures the employer's legal team is looped in early.

Find Sr Software Development Manager JobsFrequently Asked Questions
Does a Sr Software Development Manager role qualify for H-1B sponsorship?
Yes, provided the employer requires at least a bachelor's degree in computer science, engineering, or a related technical field for the specific position. Pure management roles without a defined technical degree requirement have faced H-1B RFEs, so the job description language matters. Employers who frame the role around engineering architecture decisions and technical oversight tend to have stronger petition outcomes than those emphasizing people management alone.
What visa types do employers typically sponsor for this role?
H-1B is the most common path for external hires. L-1A is available for internal transfers from a foreign affiliate, with the added benefit of no lottery. Senior candidates with significant industry recognition may qualify for O-1A based on extraordinary ability. For longer-term immigration, EB-1C (multinational manager) and EB-2 are the most common green card categories pursued from this role level.
How do I find Sr Software Development Manager roles that offer visa sponsorship?
Migrate Mate filters job listings specifically by visa sponsorship availability, so you're not sifting through hundreds of postings that don't apply to your situation. Senior engineering management roles with sponsorship appear across large tech companies, enterprise software firms, and well-funded growth-stage companies, all of which tend to have dedicated immigration support already in place.
Does USCIS approve H-1B petitions for management-heavy roles at a lower rate?
Approval rates for senior engineering management roles are generally strong when the petition clearly establishes the technical degree requirement and the role's direct engineering responsibilities. Roles that read primarily as people managers without a defensible technical specialty component carry higher RFE risk. USCIS looks for evidence that a specific bachelor's degree in a technical field is the normal minimum for entry into the occupation.
Will an L-1A visa help me get a green card faster than H-1B?
It can. L-1A holders who are sponsored for an EB-1C green card (multinational executive or manager category) skip the PERM labor certification process entirely, which removes one to two years from the timeline. EB-1C is also not subject to per-country backlogs in the same way EB-2 and EB-3 are, which is a meaningful advantage for applicants from India or China. You still need to demonstrate managerial or executive capacity continuously.
What is the prevailing wage requirement for sponsored Sr Software Development Manager jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
