Get Access To All JobsTips for Finding E-3 Visa Sponsorship as a Tax Attorney
Verify your bar admission before applying
E-3 specialty occupation requires a degree directly related to the role. For Tax Attorney positions, U.S. employers expect active bar admission in the relevant state, so confirm reciprocity rules for your Australian legal qualifications before submitting applications.
Target BigLaw and national tax practices
Large law firms with dedicated tax departments file LCAs regularly and have in-house immigration infrastructure. Focus on firms with established PERM and E-3 filing history, as they move faster from offer to sponsorship without needing to build a new process.
Highlight cross-border tax expertise specifically
Australian professionals with U.S.-Australia tax treaty knowledge, transfer pricing, or international structuring experience stand out in a crowded applicant pool. Frame your credentials around the specialty occupation definition, not just general legal experience.
Clarify the LCA wage level with your employer early
The DOL requires your employer to certify a prevailing wage before your visa is approved. Confirm which wage level applies to your role and location during offer negotiations, as mismatches between offered salary and certified wage level can delay or block your LCA.
Use Migrate Mate's E-3 filing service for end-to-end support
Once you have an offer, use Migrate Mate's E-3 filing service to handle your LCA filing, DS-160, and consulate preparation. This avoids the coordination gaps that occur when employer HR and external counsel aren't aligned on Tax Attorney classification requirements.

Find Tax Attorney JobsTax Attorney E-3 Visa: Frequently Asked Questions
How do I find Tax Attorney jobs that offer E-3 visa sponsorship?
Search Migrate Mate to filter Tax Attorney roles by E-3 sponsorship directly. Most law firms don't advertise E-3 willingness in job postings, so targeting employers with a documented history of sponsoring specialty occupation visas is more effective than cold-applying and asking about sponsorship after the fact.
How much does it cost to get an E-3 visa?
Migrate Mate's E-3 filing service covers the entire process for $499, including the Labor Condition Application, visa document preparation, and consulate appointment guidance. Traditional immigration lawyers charge $2,000–$5,000+ for the same work. The E-3 has less paperwork than most work visas, so paying thousands for legal help is usually unnecessary.
Does a Tax Attorney role qualify as a specialty occupation for E-3 purposes?
Yes. Tax Attorney roles require a Juris Doctor in law, which satisfies the E-3 specialty occupation requirement of a bachelor's degree or higher in a directly related field. USCIS treats law as a qualifying field, provided the position genuinely requires legal expertise and bar admission rather than general business advisory work.
How does the E-3 compare to the H-1B for Tax Attorney roles?
The E-3 has no annual lottery and no cap that fills, which means you can apply at any time of year without competing for a limited number of slots. The H-1B requires registration in March and selection by random draw. For Australians, the E-3 is a faster, more predictable path to U.S. tax law practice.
Can I switch Tax Attorney employers while on an E-3 visa?
Yes, but you need a new LCA certified by the DOL and a new visa stamp before starting with the new employer. There's no H-1B portability equivalent for E-3, so plan for a processing gap. If you're already in the U.S., some employers will time your start date around the new visa approval to avoid a gap in authorized status.
