Document your technical degree field precisely
PERM requires your degree to directly support the job duties. A data engineering internship tied to a computer science or statistics degree clears this bar cleanly. A degree in an unrelated field complicates the employer's labor certification application, even for intern-level roles.
Target employers with active PERM filing history
Search DOL's OFLC disclosure data to confirm which companies have filed PERM applications for data engineering roles before. Employers already running PERM processes have established internal procedures, reducing the risk that your offer gets shelved after it's made.
Clarify the job duties match EB-3 skilled worker criteria
Intern titles can create classification ambiguity. Ask your recruiter whether the role is structured as a degree-required position. If the duties involve building data pipelines or writing production-quality code, the role likely meets the DOL's skilled worker or professional threshold for EB-3.
Use Migrate Mate to filter sponsorship-ready employers
Searching broadly wastes time on employers who have never filed for foreign workers. Migrate Mate surfaces data engineering roles at companies with verified sponsorship history, so your applications go to employers who already understand the PERM and I-140 process.
Confirm prevailing wage before your offer letter is signed
DOL must certify that your employer is paying the prevailing wage for the role and location. Use the OFLC Wage Search to look up the Level I or Level II wage for your specific metro area before negotiations close. A below-prevailing offer can stall or void the PERM filing.
Ask about I-140 filing timing during the offer stage
PERM certification can take 12 to 18 months, and I-140 adjudication adds further time. Asking your employer early whether they file I-140 concurrently with PERM, or only after certification, tells you how seriously they have thought through the full sponsorship path for this role.
Green Card Data Engineer Intern: Frequently Asked Questions
Can an intern-level data engineering role qualify for EB-2 or EB-3 green card sponsorship?
Yes, if the employer defines the position as requiring at least a bachelor's degree in a specific technical field such as computer science or data engineering. EB-3 professional category covers degree-required roles at any seniority level, including internships. EB-2 applies if the role genuinely requires an advanced degree. The job description, not the title, determines eligibility under PERM labor certification.
How does green card sponsorship through PERM differ from H-1B for a data engineer intern?
PERM-based green card sponsorship leads to permanent residency rather than a temporary status, and there is no annual lottery at the EB-3 category level for most countries. H-1B visa has an 85,000-cap lottery with no guarantee of selection. PERM takes longer overall, often two to four years from start to approval, but the outcome is a green card rather than a nonimmigrant visa that must be renewed.
What role does the employer play in the PERM process for a data engineering internship?
The employer drives almost the entire PERM process. They must conduct a supervised recruitment effort to test the U.S. labor market, document that no qualified U.S. workers were available for the role, and file the ETA-9089 application with DOL. USCIS then reviews the I-140 immigrant petition once PERM is certified. You provide credentials and documentation, but the legal and filing obligations sit with your employer.
Where can I find data engineer intern jobs where the employer is willing to sponsor a green card?
Most general job boards don't filter by PERM filing history, so you can spend weeks applying to employers who have never sponsored a foreign worker. Migrate Mate is built specifically to surface roles at companies with documented sponsorship activity, making it easier to identify data engineering internships where green card sponsorship is a realistic part of the offer, not an afterthought.
Does the O*NET classification for data engineering affect my PERM eligibility?
O*NET occupation codes shape how DOL classifies the role during PERM review, which affects the prevailing wage level and the recruitment requirements your employer must meet. Data engineering roles are typically mapped to Standard Occupational Classification codes in the computer occupations group. If the O*NET profile for your specific duties requires a bachelor's degree, that strengthens the employer's case for filing under the EB-3 professional or EB-2 category.
