Document your foreign credentials before applying
PERM requires your degree to meet U.S. equivalency standards. Get a credential evaluation from a NACES-member agency that maps your foreign teaching or training qualification to a U.S. bachelor's or master's degree before submitting applications.
Target public universities and community colleges first
Public postsecondary institutions file PERM petitions more consistently than K-12 districts, which often lack in-house immigration counsel. Filter your search to two-year and four-year colleges, where HR departments routinely handle EB-2 and EB-3 sponsorship.
Search for green card sponsoring employers on Migrate Mate
Migrate Mate filters education and training roles by employers with active PERM filing history, so you avoid applying to institutions that don't sponsor. Start there before broader outreach to save time targeting roles that lead to permanent residency.
Verify your role meets specialty occupation standards
EB-2 and EB-3 PERM filings require the position to normally require a bachelor's degree in a specific field. Review the O*NET profile for your education or training role to confirm the listed education requirements align with what your target employer can document.
Ask employers about the prevailing wage determination upfront
Your employer must file a prevailing wage determination with DOL before PERM recruitment begins. Check the OFLC Wage Search for your occupational title and region so you enter salary negotiations knowing the minimum wage PERM requires your employer to offer.
Plan for PERM recruitment delays during contract negotiations
PERM requires the employer to complete a supervised DOL recruitment process before filing, which typically runs 60 to 90 days. Factor this into your start-date discussions so your employer initiates the process before your offer letter is signed rather than after.
Green Card Education And Training: Frequently Asked Questions
Which education and training roles qualify for EB-2 versus EB-3 green card sponsorship?
EB-2 covers positions that normally require an advanced degree, such as postsecondary instructors, instructional coordinators, and curriculum specialists where a master's degree is the standard. EB-3 covers skilled roles requiring at least a bachelor's degree, including training specialists and educational program managers. Your employer's job description and the DOL prevailing wage determination determine which category applies.
How does PERM green card sponsorship differ from H-1B for education and training professionals?
H-1B visa is a temporary nonimmigrant status capped at 85,000 per year and subject to an annual lottery. PERM-based EB-2 and EB-3 sponsorship leads to lawful permanent residency with no lottery and no temporary expiration. The PERM process takes longer upfront, often 18 to 36 months from filing to green card approval, but the outcome is permanent status rather than a visa you must renew.
Can K-12 school districts sponsor foreign teachers for a green card?
Yes, but K-12 districts do so less consistently than higher-education institutions because PERM requires dedicated legal resources many smaller districts lack. Larger urban districts and charter management organizations with HR infrastructure are more likely candidates. Some states also run special teacher visa programs, though those are separate from the EB-2 and EB-3 PERM route and do not lead directly to a green card.
How do I find education and training employers who actively sponsor green cards?
Migrate Mate lets you search education and training roles filtered by employers with verified PERM filing history, which removes the guesswork of cold-applying to institutions that don't sponsor. Focusing on employers who have completed PERM filings before shortens your job search and increases the likelihood your offer letter leads to a green card petition.
What happens to my PERM case if I change employers partway through the process?
The PERM labor certification is employer-specific and cannot transfer if you change jobs before the I-140 is approved. If your I-140 has been approved for more than 180 days, AC21 portability may let you move to a similar role with a new employer without restarting the green card process. Confirm with your employer's immigration counsel before accepting any new position during an active PERM case.
