Document your specialized technical contributions early
PERM requires proving your role requires a minimum degree in a specific field. Build a paper trail now: patents filed, architecture decisions owned, and peer-reviewed work that ties your credentials directly to the Founding Engineer job duties.
Target startups that have cleared Series A funding
Pre-seed companies rarely have the legal infrastructure or cash reserves to sustain a multi-year PERM process. Series A or later funding signals the employer can absorb filing costs and won't abandon sponsorship mid-process if priorities shift.
Clarify the job description before PERM gets filed
PERM locks in the job duties and minimum requirements permanently. If the role description filed with DOL doesn't match your actual responsibilities, it creates compliance risk. Review the draft before your employer submits to OFLC.
Use Migrate Mate to find verified sponsoring employers
Identifying startups with active green card sponsorship history isn't straightforward. Migrate Mate surfaces Founding Engineer roles from employers with documented PERM filing records, so you can focus outreach on companies already set up to sponsor.
Confirm your EB category before accepting the offer
Founding Engineer roles typically require a bachelor's degree in computer science or engineering, which qualifies under EB-3. If you hold a master's or can demonstrate advanced credentials, ask your employer to evaluate EB-2 eligibility before PERM is initiated.
Understand the concurrent filing option if your priority date is current
If your country of birth has a current priority date in the Visa Bulletin, your employer may be able to file the I-140 and your I-485 adjustment of status at the same time, cutting months off your wait for permanent residency.
Green Card Founding Engineer: Frequently Asked Questions
Does a Founding Engineer role qualify for EB-2 or EB-3 green card sponsorship?
Most Founding Engineer positions qualify under EB-3 as a skilled worker role requiring at least a bachelor's degree in computer science, software engineering, or a related field. If the role requires an advanced degree or you can demonstrate specialized credentials above the standard requirement, your employer may pursue EB-2 instead. The distinction affects processing priority and, in some cases, priority date movement, so confirm the category before PERM is filed.
How does green card sponsorship differ from H-1B sponsorship for a Founding Engineer?
H-1B visa is a temporary status tied to employer sponsorship and subject to annual lottery selection. Green card sponsorship through PERM is permanent, has no lottery, and results in lawful permanent residency rather than a time-limited work visa. The trade-off is time: PERM labor certification, I-140 approval, and adjustment of status can take two to four years or longer depending on your country of birth and the employment-based visa backlog.
Will an early-stage startup actually sponsor a green card for a Founding Engineer?
Some do, but it depends on funding stage and legal maturity. Companies with Series A funding or later are more likely to have immigration counsel in place and the budget to cover PERM filing and attorney fees. Ask directly during offer negotiation whether the company has sponsored green cards before and whether they'll commit to initiating PERM within a defined timeframe after your start date.
Where can I find Founding Engineer jobs that include green card sponsorship?
Migrate Mate is built specifically for this search. It filters Founding Engineer roles by employers with documented PERM filing history, so you're not guessing which companies will actually sponsor. Standard job boards don't filter by green card sponsorship intent, which means most listings you find there won't lead to permanent residency even if the employer hires internationally.
What happens to my green card process if the startup shuts down before my I-140 is approved?
If your employer closes before the I-140 is approved, the PERM labor certification and any pending petition generally cannot be transferred to a new employer. You'd need to restart the process. If the I-140 was already approved, portability rules under AC21 may allow you to transfer the priority date to a new employer's petition in the same or a similar occupational classification, preserving your place in the queue.
