Align your credentials to SOC codes
USCIS evaluates your degree against your job duties using the SOC classification. Pull the O*NET profile for AI Consultant roles and confirm your degree field maps directly to the listed education requirements before applying.
Target employers with LCA filing history
Use Migrate Mate to filter AI Consultant roles by employers who have filed Labor Condition Applications for this occupation. Filing history signals an established H-1B process, not a one-time attempt.
Verify prevailing wage before negotiating
Run your target role and work location through the OFLC Wage Search before salary talks. Your offer must meet the DOL prevailing wage for Level I through Level IV, and underbidding can trigger an RFE after filing.
Confirm E-Verify enrollment before the offer stage
Some AI Consultant contracts sit within federal supply chains, requiring employers to be E-Verify enrolled. Ask HR directly during early interviews so you don't reach the offer stage with a non-compliant employer.
Request a detailed specialty occupation letter
AI Consultant duties can overlap with general IT project management, which USCIS scrutinizes. Ask your employer to draft a support letter tying each project deliverable to a specific degree requirement in AI, machine learning, or data engineering.
Time your cap filing around project start dates
H-1B cap petitions can be filed up to six months before your October 1 start date. Work with your employer to lock a project start date that lets them file in April, avoiding a gap between your OPT expiration and H-1B activation.
H-1B Visa AI Consultant: Frequently Asked Questions
Does an AI Consultant role qualify as an H-1B specialty occupation?
Yes, provided the position requires at least a bachelor's degree in a directly related field such as computer science, data science, or artificial intelligence. Roles that accept any bachelor's degree regardless of field are vulnerable to USCIS RFEs. The job description must tie specific duties, such as model development or algorithm design, to a specialized degree requirement.
Which employers sponsor H-1B visas for AI Consultant positions?
Technology firms, management consulting practices, and enterprise software companies are the most consistent H-1B filers for AI Consultant roles. Migrate Mate surfaces employers by their DOL Labor Condition Application filing history for this specific occupation, so you can target companies with an established sponsorship track record rather than guessing from job listings.
Can I work as a contractor or on a client site on an H-1B as an AI Consultant?
Yes, but the petitioning employer must maintain a bona fide employer-employee relationship and control your work. USCIS applies additional scrutiny to third-party placement arrangements, requiring an itinerary of assignments and end-client letters confirming the specialty occupation duties. Project-based consulting engagements without a clear client letter are a common source of RFEs.
What happens to my H-1B status if my consulting project ends early?
You enter a 60-day grace period from the date your employment ends, during which you can find a new sponsoring employer, change status, or prepare to depart. Your new employer can file an H-1B transfer petition during this window, and your authorization continues through the transfer as long as the petition is filed before the grace period expires.
Is an AI Consultant role subject to the H-1B lottery?
Most private-sector AI Consultant positions are subject to the annual H-1B cap and lottery, which covers 65,000 regular-cap slots plus 20,000 for U.S. master's degree holders. Positions at universities, affiliated nonprofit research organizations, or government research institutions are cap-exempt and can be filed at any time. USCIS confirms cap-exempt status based on the employer's classification, not the job title.
