Map your degree to the role
USCIS evaluates whether your specific degree field directly relates to product software engineering work. A computer science or software engineering degree is cleanest. An unrelated degree paired with a credential evaluation and relevant coursework can still qualify, but expect closer scrutiny.
Search LCA filings before applying
Use Migrate Mate to filter Product Software Engineer roles by employers with verified DOL Labor Condition Application filing history, so you're targeting companies that have already navigated the H-1B process for this exact job title.
Check prevailing wage before negotiating
Your offer must meet the DOL prevailing wage for your job title and work location. Run the OFLC Wage Search using the SOC code for software developers before accepting an offer, so you know the floor your employer is legally required to meet.
Confirm the product team's H-1B timeline
Product engineering hires often move fast, but H-1B cap-subject petitions can only be filed for an October 1 start date. Ask recruiters early whether they plan premium processing and whether their fiscal year hiring cycle accommodates the April filing window.
Use O*NET to document specialty occupation
If your employer receives an RFE challenging specialty occupation status, the O*NET profile for software developers supports the argument that the role normally requires a specific bachelor's degree. Reference it when reviewing your I-129 petition before it's filed.
Address cap-gap if you're transitioning from OPT
If your OPT expires before October 1 and your H-1B petition is pending, the cap-gap rule automatically extends your work authorization. Confirm your employer's HR team understands this so there's no unnecessary gap in payroll processing.
H-1B Visa Product Software Engineer: Frequently Asked Questions
Does a Product Software Engineer role qualify as an H-1B specialty occupation?
Yes. USCIS classifies software engineering and product-focused engineering roles as specialty occupations because they normally require at least a bachelor's degree in a directly related field like computer science or software engineering. The employer confirms this in the Labor Condition Application filed with DOL before the H-1B petition. Roles with vague titles may need additional documentation to establish the degree requirement.
How do I find Product Software Engineer employers who sponsor H-1B visas?
Migrate Mate filters Product Software Engineer listings by employers with active DOL Labor Condition Application filing history, so you can see which companies have already sponsored H-1B workers in this role category. This is more reliable than guessing from job postings, which rarely state sponsorship availability upfront.
What happens to my H-1B if my product team is restructured or I'm laid off?
You have a 60-day grace period after losing H-1B employment to find a new sponsor, change status, or depart the U.S. The new employer must file an H-1B transfer petition before you start work. If you're on a cap-exempt employer's petition, transferring to a cap-subject employer may require a new lottery registration depending on your situation.
Can I work for a startup as a Product Software Engineer on an H-1B?
Yes, but startups must meet the same employer requirements as large companies: valid FEIN, ability to pay the prevailing wage, and capacity to file the LCA with DOL and the I-129 petition with USCIS. Smaller companies without in-house immigration counsel sometimes underestimate the timeline and paperwork involved, so ask early whether they've sponsored H-1B workers before.
How does the H-1B prevailing wage requirement affect Product Software Engineer offers?
DOL sets four wage levels for each occupation and work location. Your employer must pay at least the prevailing wage for your level, which is determined by your specific duties and experience, not just your job title. Product engineers at Level II or III typically see higher floors than entry-level software roles. Use the OFLC Wage Search to verify the wage tier before your offer letter is finalized.
