Map your degree to the role
USCIS requires your degree field to directly relate to Territory Business Manager duties. A marketing, business administration, or sales management degree strengthens your specialty occupation argument. A general liberal arts degree may trigger an RFE without supplemental coursework documentation.
Check prevailing wages before negotiating
Use the OFLC Wage Search to find the Level I through Level IV wage for your territory's metropolitan statistical area before your offer letter is signed. Accepting below the certified LCA wage creates a compliance violation your employer can't legally correct after filing.
Target employers with multi-state territory structures
Companies managing national or regional territories through dedicated headcount are more likely to have established H-1B filing processes. Search Migrate Mate to filter Territory Business Manager roles by employers with verified H-1B LCA filing history in your target geography.
Clarify how your territory assignment affects the LCA
If your role covers multiple states, your employer may need to file separate LCA postings in each work location. Ask HR whether your offer covers a single worksite or requires a blanket LCA to avoid a compliance gap after you start.
Verify E-Verify enrollment before your start date
USCIS requires H-1B employers to be E-Verify participants when the employee works at a location not listed on the original petition. Confirm your employer is actively enrolled in E-Verify before you accept an offer, especially if your territory involves remote or client-site work.
Use O*NET to document specialty occupation evidence
Pull the O*NET occupation profile for Sales Managers or related SOC codes and note the education requirements listed under Job Zone. Include this alongside your offer letter when your attorney builds the specialty occupation argument for your I-129 petition.
H-1B Visa Territory Business Manager: Frequently Asked Questions
Does a Territory Business Manager role qualify as a specialty occupation for H-1B purposes?
It can, but the employer must demonstrate the position normally requires at least a bachelor's degree in a specific field like business, marketing, or sales management. Roles where any general degree qualifies are harder to defend. Your employer's petition should document the complexity of the territory management duties and tie them directly to a relevant degree discipline.
How does working across multiple states affect my H-1B petition as a Territory Business Manager?
If your territory spans multiple states, your employer must file LCA postings in each location where you regularly work. Short-term assignments under 60 workdays in a rolling year may qualify for a short-term placement exception, but permanent multi-state coverage requires full LCA compliance in each state. Confirm your HR team understands this before your petition is filed.
Can I change territories or take on a new region while on H-1B status?
A significant change in worksite location requires your employer to file an amended H-1B petition with USCIS before the change takes effect. Adding a new state to your territory or relocating your primary worksite both trigger this requirement. Minor schedule adjustments within the same metro area typically don't require an amendment, but your employer should confirm with immigration counsel.
What should I look for in an employer's H-1B sponsorship history for this role?
Look for employers who have filed LCAs specifically for sales or business development roles in your target region, not just technical positions. Migrate Mate shows verified LCA filing history by employer and occupation code, so you can see which companies have sponsored Territory Business Manager roles before rather than relying on recruiter claims.
Does a commission-based compensation structure affect my H-1B wage compliance?
USCIS requires your total compensation to meet or exceed the prevailing wage certified on the LCA. If a portion of your pay is variable commission, your base salary alone must still satisfy the prevailing wage floor. An offer structured mostly on commission with a low base salary creates compliance risk even if on-target earnings exceed the threshold.
