Verify your credentials meet ECFMG standards
Before any U.S. employer can file your H-1B petition, you'll need ECFMG certification confirming your medical degree and completed residency. Get this process started early since document reviews can take several months.
Check prevailing wage levels for your subspecialty
Thoracic surgery spans general thoracic, cardiac, and congenital subspecialties, each mapped to different SOC codes. Run your specific title through the OFLC Wage Search to see which wage level your employer must certify before filing your LCA.
Target academic medical centers with cap-exempt status
Many teaching hospitals and university health systems qualify as cap-exempt H-1B employers, meaning your petition bypasses the annual lottery entirely. Confirm cap-exempt status directly with the hospital's legal or HR team before accepting an offer.
Search verified H-1B sponsors on Migrate Mate
Filter by thoracic surgery roles on Migrate Mate to see which hospital systems and surgical groups have active LCA filing history, so you're targeting employers with a documented track record of sponsoring surgeons.
Negotiate premium processing into your offer package
USCIS premium processing guarantees a decision on your I-129 petition within 15 business days. Ask the employer to include this during offer negotiations so your start date isn't delayed by a standard adjudication backlog.
Understand how J-1 waivers interact with H-1B timing
If you completed a U.S. residency or fellowship on a J-1 visa, your two-year home residency requirement must be waived before USCIS can approve your H-1B. Apply for a Conrad 30 or federal agency waiver well ahead of your intended start date.
H-1B Visa Thoracic Surgeon: Frequently Asked Questions
Does thoracic surgery qualify as a specialty occupation for H-1B purposes?
Yes. Thoracic surgery requires a medical degree plus a specialized surgical residency and fellowship, satisfying USCIS's definition of a specialty occupation. The role falls under a specific SOC code that DOL and USCIS both recognize as requiring theoretical and practical application of highly specialized knowledge, so qualification is rarely contested.
Can I get an H-1B without going through the annual lottery?
Many thoracic surgeons can. Academic medical centers, university-affiliated hospitals, and nonprofit research institutions often qualify as cap-exempt H-1B employers. If your employer holds that status, your petition goes directly to USCIS for adjudication with no lottery dependency. Confirm cap-exempt eligibility with the employer's legal team before signing an offer.
How do I find hospitals that have sponsored H-1B visas for surgeons before?
Migrate Mate displays LCA filing history by employer and occupation, so you can identify hospital systems and surgical groups that have sponsored thoracic or cardiothoracic roles. Filtering by specialty gives you a shortlist of employers with documented H-1B experience, which reduces risk on both sides of the hiring process.
How does the J-1 to H-1B transition work for surgeons who trained in the U.S.?
If you completed residency or fellowship on a J-1 visa, you're subject to a two-year home residency requirement before H-1B approval unless you obtain a waiver. Conrad 30 waivers are available through state health departments for physicians who commit to working in underserved areas. Federal agency waivers are also available. The waiver must be approved before USCIS adjudicates your H-1B petition.
What role does the employer play in the H-1B filing process for a thoracic surgeon?
The employer drives the entire filing process. They file the LCA with DOL to certify the prevailing wage, then submit Form I-129 to USCIS on your behalf. You can't self-petition for an H-1B. Most large hospital systems use in-house immigration counsel or outside law firms, so ask early who manages the process and what your expected start date timeline looks like.
