How to Get Visa Sponsorship in Senior Litigation Counsel
Confirm your bar admission transfers
Most employers require active bar admission in the state where you'll practice. Some roles accept pro hac vice eligibility or admission in a second state. Confirm licensing requirements with the employer before investing time in the application process.
Target in-house legal departments first
Fortune 500 legal departments and financial institutions sponsor Senior Litigation Counsel more consistently than law firms. In-house roles have structured budgets for immigration costs and are less likely to withdraw sponsorship due to partnership track pressures or billing concerns.
Position your litigation specialty precisely
Complex commercial litigation, securities litigation, and product liability defense attract the most sponsorship activity. Narrowing your application to a specific practice area signals expertise and makes the employer's H-1B specialty occupation argument to USCIS considerably stronger.
Get your foreign law degree evaluated early
If your J.D. or LL.B. is from outside the U.S., obtain a credential evaluation from a NACES-accredited service before applying. Some employers require this upfront to confirm the degree satisfies specialty occupation requirements under USCIS standards.
Document your litigation track record in detail
Senior roles require demonstrating progressively complex case experience. Prepare a litigation portfolio listing case types, court levels, and outcomes you can discuss. This supports both employer interviews and any O-1A petition that relies on demonstrated expertise in your field.
Use Migrate Mate to filter for sponsoring employers
Not every litigation role comes with sponsorship. Migrate Mate surfaces Senior Litigation Counsel positions from employers with documented H-1B and O-1A sponsorship histories, saving you from applying to roles where immigration support was never an option.

Can Senior Litigation Counsel roles qualify for H-1B sponsorship?
Yes. Senior Litigation Counsel is a classic specialty occupation because the role requires at minimum a J.D. in law, and no employer hires for this position without one. USCIS has consistently approved H-1B petitions for attorney roles at this seniority level, particularly when the petition clearly documents the complexity of the litigation work and the specific legal expertise required.
Do I need a U.S. law degree to get sponsored as a Senior Litigation Counsel?
Not necessarily, but you must hold a degree equivalent to a U.S. J.D. and pass the bar in the relevant jurisdiction. Foreign LL.B. or LL.M. holders often qualify after a NACES-accredited credential evaluation. Some states, including California and New York, allow foreign-trained attorneys to sit for the bar after meeting specific requirements, which opens a direct path to practice eligibility and sponsorship.
Is the O-1A visa a realistic option for experienced litigators?
For attorneys with a strong track record, O-1A is worth evaluating seriously. Criteria that litigators can often satisfy include significant case outcomes, media coverage of major trials, published legal commentary or expert testimony, bar leadership roles, and high compensation relative to peers. The O-1A bypasses the H-1B lottery entirely, which makes it particularly valuable for attorneys who missed cap registration or are changing employers mid-year.
Which types of employers are most likely to sponsor Senior Litigation Counsel?
In-house legal departments at publicly traded companies, financial institutions, insurance carriers, and large healthcare systems are the most consistent sponsors. Government contractors with substantial compliance litigation needs also hire regularly at this level. BigLaw firms do sponsor, but partnership track dynamics and client billing concerns can complicate long-term immigration support. Browse current openings on Migrate Mate to find employers with verified sponsorship histories in this role category.
How does bar admission in multiple states affect my sponsorship options?
Admission to more than one state bar meaningfully expands your employer pool, since many in-house departments handle litigation across jurisdictions. For H-1B purposes, the employer's petition must align your bar admission with the specific state where you'll primarily work. If you're admitted in a high-demand jurisdiction like New York, California, or Delaware, you'll find more sponsoring employers actively recruiting at the Senior Counsel level.
What is the prevailing wage requirement for sponsored Senior Litigation Counsel jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
