Green Card Attorney General Jobs
Attorney General roles sit at the intersection of executive authority and legal expertise, making them one of the more complex pathways for employment-based green card sponsorship. PERM labor certification requires your employer to document that no qualified U.S. workers are available, a high bar for a position with constitutional or statutory underpinnings at the state or federal level.

Document your foreign law credentials carefully
U.S. employers filing PERM for a legal executive role need your foreign law degree evaluated for equivalency. Get a credential evaluation from a NACES-member organization before you begin applications, so your EB-2 or EB-3 eligibility is documented from the start.
Target state agencies with established PERM history
State governments occasionally sponsor foreign nationals for senior legal roles when no qualified U.S. applicant is found. Check DOL PERM disclosure data to identify which state offices have successfully certified positions in legal administration or government counsel roles.
Understand the specialty occupation argument for EB-2
Attorney General roles typically require a Juris Doctor or equivalent advanced degree, making EB-2 the natural fit for advanced-degree professionals. Your sponsor must demonstrate the role habitually requires that degree, not merely prefers it, when filing with USCIS.
Use Migrate Mate to find green card-sponsoring legal employers
Search Migrate Mate to filter employers with active EB-2 or EB-3 PERM filing history in legal and government roles. Leading with employers already familiar with the sponsorship process shortens your timeline and reduces the risk of a sponsor withdrawing mid-process.
Negotiate PERM filing timing into your offer
PERM labor certification can take 18 months or more from filing to I-140 approval. Ask your prospective employer to commit to initiating PERM within 90 days of your start date so your priority date is established before backlogs shift.
Prepare for the supervised recruitment audit requirement
DOL audits a significant share of PERM applications, especially for senior legal roles where the job duties are narrowly defined. Work with your employer to retain all recruitment records, including rejection reasons for each U.S. applicant reviewed, before the petition is submitted.
Green Card Attorney General: Frequently Asked Questions
Can a foreign national be sponsored for an Attorney General role through the green card process?
Yes, but the path is narrow. Attorney General positions are typically government roles, and public employers can sponsor foreign nationals through PERM labor certification if they can demonstrate no qualified U.S. worker is available. The employer files a PERM application with DOL, and if certified, follows with an I-140 petition to USCIS. The role's advanced degree requirement usually supports an EB-2 classification.
How does green card sponsorship differ from H-1B for Attorney General roles?
Green card sponsorship through EB-2 or EB-3 PERM is permanent residency, not a temporary work authorization. Unlike the H-1B visa, there is no annual lottery for EB-3, and the employer's commitment extends through the full PERM, I-140, and adjustment of status process. The timeline is longer, often two to four years, but the outcome is lawful permanent residency rather than a visa requiring renewal.
What degree or credential does the PERM application require for this role?
Most Attorney General positions are defined around a Juris Doctor or equivalent foreign law degree, plus bar admission. For PERM purposes, your employer must specify the minimum requirements in the job description and demonstrate those requirements are occupationally necessary. If your degree was issued outside the U.S., a NACES-accredited credential evaluation is required to establish equivalency for USCIS review.
Where can I find employers who sponsor green cards for Attorney General roles?
Migrate Mate lets you search for employers with documented EB-2 and EB-3 PERM filing history in legal and government sectors. Targeting employers who have already completed the PERM process for similar roles is the most practical way to find sponsorship-ready opportunities, since those employers understand the filing timeline and have established relationships with immigration counsel.
What is the prevailing wage requirement for PERM sponsorship of this role?
DOL requires your sponsoring employer to pay at least the prevailing wage for the Attorney General role in the specific geographic area. The employer submits a Prevailing Wage Determination request to OFLC before filing PERM. You can review prevailing wage levels for this occupation using the OFLC Wage Search tool or by referencing Bureau of Labor Statistics wage data for the relevant metro area.
