Match your credentials to the right EB category
EB-3 covers legal assistants with a bachelor's degree or at least two years of specialized experience. If you hold an advanced degree in law or a related field, document it carefully because it can support an EB-2 filing and reduce your priority date wait.
Target law firms with established PERM pipelines
Large litigation firms, BigLaw offices, and corporate legal departments sponsor foreign legal staff more often than solo practitioners. Check DOL PERM disclosure data to confirm a firm has filed labor certifications before you apply, not after you receive an offer.
Use the OFLC Wage Search before salary negotiations
Your employer must pay at least the prevailing wage for Legal Assistant roles in your specific metro area. Pull the OFLC Wage Search figure yourself so you can verify the offer meets DOL requirements and avoid a PERM audit triggered by a below-threshold salary.
Find green-card-sponsoring employers through Migrate Mate
Search Legal Assistant roles filtered by EB-2 and EB-3 sponsorship history on Migrate Mate. The platform surfaces employers whose PERM and I-140 filing records confirm they've navigated the full green card process for this job category before.
Prepare a detailed work-history record early
PERM requires your employer to document that no qualified U.S. worker applied. Your certified translations, foreign degree equivalency letters, and a precise employment chronology should be ready before the recruitment period opens, not assembled after an RFE arrives.
Understand concurrent filing once your I-140 is approved
Once your employer files an approved I-140, you may be eligible to file Form I-485 concurrently if a visa number is available for your country. Confirm your priority date against the monthly USCIS Visa Bulletin before submitting adjustment of status paperwork.
Green Card Legal Assistant: Frequently Asked Questions
Do Legal Assistant jobs typically qualify for EB-2 or EB-3 green card sponsorship?
Most Legal Assistant positions qualify under EB-3 as skilled workers requiring at least two years of training or a bachelor's degree. EB-2 sponsorship is possible if the role requires an advanced degree and the employer can justify that requirement in the PERM job description. Your specific credentials and the employer's documented minimum requirements determine which category applies.
How does green card sponsorship differ from H-1B sponsorship for Legal Assistants?
Green card sponsorship through EB-3 has no annual lottery and no cap that blocks approval the way the H-1B visa cap does for most employers. The tradeoff is timeline: PERM labor certification, I-140 approval, and adjustment of status can take two to four years or longer depending on your country of birth. The result is permanent residency rather than a temporary status requiring renewal every few years.
What is the PERM process and how does it affect my Legal Assistant job search?
PERM is the DOL labor certification that proves no qualified U.S. worker was available for your role. Your employer runs a supervised recruitment period, documents results, and files ETA Form 9089 with DOL. The process can take six to twelve months before an I-140 petition is even filed, so targeting employers already familiar with PERM for legal support staff shortens your overall timeline significantly.
How can I find Legal Assistant jobs where employers are ready to sponsor a green card?
Use Migrate Mate to search Legal Assistant openings filtered by employers with confirmed EB-2 and EB-3 sponsorship history. Many job listings describe themselves as open to sponsorship without specifying whether the employer has ever completed a PERM filing. Migrate Mate surfaces employers whose DOL records show they've successfully navigated the full process for this role category.
Can a foreign credential in law or paralegal studies count toward EB-3 eligibility?
Yes, but the credential must be evaluated by a USCIS-recognized credential evaluation service to establish U.S. equivalency. A three-year foreign law degree may satisfy the bachelor's degree requirement depending on the evaluator's assessment. Your employer's PERM job description must also list the degree as a minimum requirement, not merely preferred, for the certification to hold up to DOL scrutiny.
