Green Card Data Science Engineer Jobs
Data Science Engineer roles consistently qualify for EB-2 and EB-3 green card sponsorship through the PERM labor certification process, which requires employers to document that no qualified U.S. worker is available before filing your I-140 petition. Roles combining machine learning, statistical modeling, and production engineering typically satisfy specialty occupation requirements for advanced-degree professionals seeking permanent U.S. residency.

Get Access To All JobsTips for Finding Green Card Sponsorship as a Data Science Engineer
Document your specialized technical credentials early
Gather official transcripts, degree equivalency evaluations, and employer letters describing your work with production ML systems or data pipelines. PERM requires credential documentation before the labor market test begins, so delays here stall the entire timeline.
Target employers with active PERM filing history
Use the OFLC Wage Search to look up recent PERM certifications filed for data science titles at companies you're targeting. Employers who have sponsored similar roles understand the process and are far less likely to abandon a petition mid-filing.
Clarify EB-2 versus EB-3 suitability before accepting an offer
If your role requires an advanced degree or you hold one, ask the employer whether they plan to file under EB-2 or EB-3. EB-2 allows self-petition via National Interest Waiver in some data science contexts, which removes the PERM labor market test entirely.
Search for sponsoring employers using Migrate Mate
Filter by Data Science Engineer roles with documented green card sponsorship history using Migrate Mate. You'll see which employers have filed PERM certifications for this exact title, cutting out the guesswork of cold-applying to companies with no sponsorship track record.
Align your job title to O*NET classifications
DOL evaluates PERM applications against O*NET occupation codes and prevailing wage levels. Confirm your offered title maps cleanly to a recognized data science or software engineer occupation code before your employer submits the prevailing wage determination request.
Understand priority date backlog risk before filing
If you were born in India or China, EB-2 and EB-3 priority date backlogs can mean waiting years after USCIS approves your I-140 before you can adjust status. Factor this into your offer negotiation, particularly around job portability provisions after 180 days.
Green Card Data Science Engineer: Frequently Asked Questions
Do Data Science Engineer roles qualify for EB-2 or EB-3 green card sponsorship?
Most Data Science Engineer positions qualify for both EB-2 and EB-3 depending on the degree requirement in the job description. EB-2 applies when the role requires an advanced degree or equivalent, which covers many senior data science positions. EB-3 covers roles requiring at least a bachelor's degree. Your employer's attorney will recommend the category based on how the position is defined in the PERM application.
How does green card sponsorship differ from H-1B sponsorship for this role?
Green card sponsorship through PERM is a permanent pathway with no annual cap at the EB-3 level for most nationalities, unlike H-1B visa which is subject to an annual lottery. The tradeoff is time: PERM requires a formal labor market test lasting several months before your employer can file the I-140 petition. H-1B processing can be faster, but approval is not guaranteed each year. Many data science professionals pursue both simultaneously.
What does the PERM labor certification process involve for a Data Science Engineer?
Your employer must conduct a DOL-supervised recruitment campaign, including job postings and documentation showing no qualified U.S. worker applied and was rejected. The role's requirements, including degree level and technical skills like machine learning or data pipeline development, must match what was listed in the prevailing wage determination. The entire process typically takes six to twelve months before USCIS receives the I-140 petition.
How can I find Data Science Engineer jobs that already sponsor green cards?
Migrate Mate lets you search specifically for Data Science Engineer roles where employers have a documented PERM sponsorship history. This filters out companies that list sponsorship as a possibility but have never actually filed, saving you from offers that stall once visa paperwork starts. You can filter by role, location, and sponsorship type to identify employers who have completed this process for comparable positions.
Can I change employers after my green card petition is filed?
Yes, under AC21 portability provisions you can change to a same or similar role after your I-140 is approved and your application has been pending for 180 days or more. For Data Science Engineers, USCIS typically evaluates whether the new role shares the same occupational classification and duties. Your new employer does not need to restart the PERM process, but you should work with an immigration attorney to document the job comparability.
