Align your portfolio with PERM job requirements
PERM requires your employer to define the role's minimum qualifications before filing. Make sure your GitHub repos, app store publications, and technical documentation match those stated requirements exactly, or the labor certification can be challenged.
Target employers with active EB-3 filing history
Search the DOL's OFLC disclosure data for employers who have filed PERM applications for software and mobile development roles. Companies that have done it before understand the process and are far less likely to withdraw sponsorship mid-filing.
Use Migrate Mate to filter green card sponsoring employers
Search Migrate Mate by role and filter for employers with employment-based green card sponsorship history. This narrows your search to companies that have already navigated PERM for mobile development positions, saving you months of trial and error.
Clarify your EB-2 or EB-3 eligibility before accepting an offer
EB-2 requires a master's degree or its equivalent in a relevant field. If your mobile development background relies on a bachelor's plus experience, confirm with your prospective employer whether they'll file EB-2 or EB-3 before you negotiate your offer.
Negotiate the PERM recruitment timeline into your start date
PERM requires the employer to complete a supervised recruitment process that typically runs several months before filing. Factor this into your onboarding conversation so your employer initiates the DOL process promptly after your hire date.
Document cross-platform skills using O*NET occupation codes
USCIS and DOL adjudicators reference O*NET codes when evaluating specialty occupation claims. Mapping your Flutter, React Native, or Swift experience to the O*NET profile for software developers strengthens the employer's attestation that your role qualifies.
Green Card Mobile App Developer: Frequently Asked Questions
Does a Mobile App Developer role qualify for EB-2 or EB-3 green card sponsorship?
Mobile App Developer positions typically qualify under both EB-2 and EB-3, depending on how the employer defines the role. EB-2 applies when the position requires a master's degree or equivalent advanced credentials in computer science, software engineering, or a related field. EB-3 covers roles requiring at least a bachelor's degree. Your employer specifies the educational requirement in the PERM labor certification, which determines which category applies.
How does PERM green card sponsorship differ from H-1B sponsorship for mobile developers?
H-1B visa is a temporary work visa capped at 85,000 per year and subject to an annual lottery. PERM-based green card sponsorship has no annual cap at the petition level and results in permanent residency rather than a renewable temporary status. The trade-off is timeline: PERM labor certification and the I-140 petition process can take one to three years before you reach adjustment of status, whereas H-1B approval can happen within months.
Can I search specifically for Mobile App Developer jobs that include green card sponsorship?
Yes. Migrate Mate lets you search Mobile App Developer roles filtered by employers with verified employment-based green card sponsorship history, so you're not wasting applications on companies that have never filed PERM. Filtering by sponsorship history at the role level is more reliable than asking recruiters, who often conflate H-1B sponsorship with green card sponsorship.
What happens to my green card case if I change employers mid-process?
If you change employers after your I-140 petition has been approved and your priority date is current or close, AC21 portability may allow you to transfer your case to a new employer in a same or similar occupational classification. If you leave before I-140 approval, the PERM labor certification is generally tied to the sponsoring employer and cannot transfer, meaning the process restarts from the beginning.
Does my country of birth affect how long EB-2 or EB-3 green card sponsorship takes for mobile developers?
Yes, significantly. Nationals of India and China face priority date backlogs in the EB-2 and EB-3 categories that can extend the wait for adjustment of status by many years, even after PERM and I-140 are approved. Nationals of most other countries fall under the Rest of World cutoff dates, which move faster. Check the monthly USCIS Visa Bulletin to understand your current priority date position.
