Document your product lifecycle contributions precisely
PERM requires your employer to define a specific minimum requirement for the role. Gather performance reviews, project scopes, and launch documentation showing your specialized R&D or commercialization work before the labor certification process begins.
Target employers with PERM filing history
Companies that have filed PERM applications for New Product Development roles already understand the DOL audit requirements and specialty occupation framing. Use Migrate Mate to search for green-card-sponsoring employers filtered by this job category.
Clarify whether your role qualifies as EB-2 or EB-3
EB-2 covers advanced-degree professionals or EB-2-eligible candidates with distinguished credentials. EB-3 covers roles requiring a bachelor's degree. The distinction affects your priority date and total timeline, so confirm your classification with your employer's immigration counsel before the I-140 is filed.
Understand the prevailing wage requirement for your market
Your employer must pay at least the DOL-certified prevailing wage for your position and location. Check the OFLC Wage Search to see what Level II or Level III wages apply to your New Product Development role before negotiating your offer.
Prepare your educational credentials for PERM review
If your degree is from outside the U.S., get a credential evaluation completed early. PERM job requirements must match your actual qualifications, and a delayed evaluation can stall the labor certification filing by several months.
Ask employers about concurrent filing eligibility
Once your priority date is current, you may be able to file your I-140 and I-485 adjustment of status simultaneously, cutting months off the process. Confirm with USCIS Visa Bulletin guidance whether your country and preference category allow concurrent filing at offer stage.
Green Card New Product Development: Frequently Asked Questions
Do New Product Development jobs commonly qualify for EB-2 or EB-3 green card sponsorship?
Yes. New Product Development roles typically require at minimum a bachelor's degree in engineering, business, or a related field, placing them squarely in EB-3 professional territory. Roles requiring a master's degree or equivalent specialized experience in R&D strategy, technical product commercialization, or advanced materials development can qualify under EB-2. Your employer's immigration attorney will determine the appropriate category based on the specific job duties and minimum requirements set in the PERM application.
How does the green card process differ from H-1B sponsorship for this role?
The green card path via PERM, I-140, and adjustment of status leads to permanent residency rather than temporary status. Unlike the H-1B lottery, there's no annual random selection for EB-3, though country-specific backlogs apply for applicants from India and China. PERM adds a DOL labor market test step that H-1B visa does not require, making employer commitment and timeline planning more critical from the start.
What does the PERM labor certification process look like for a New Product Development role?
Your employer posts the position through a DOL-prescribed recruitment process, documents that no qualified U.S. workers applied, and certifies it to the DOL. For specialized New Product Development roles, defining the precise minimum requirements matters: overly generic job descriptions can trigger audits. The certification step alone can take six to twelve months, followed by the I-140 petition and the wait for a current priority date before you can file for adjustment of status.
How can I find employers who actively sponsor green cards for New Product Development positions?
Searching general job boards won't surface green card sponsorship willingness reliably. Migrate Mate lets you search specifically for employers with green card sponsorship history in product development roles, so you're targeting companies that have already completed PERM filings rather than hoping an employer will agree to sponsor after an offer.
Does my country of birth affect my green card timeline in this category?
Yes. Priority dates for EB-2 and EB-3 are current for most nationalities, meaning the wait after I-140 approval is minimal. Applicants born in India and China face significant backlogs in both categories due to per-country annual limits. If you're subject to a backlog, your employer can still file and certify your PERM early so your priority date is established as soon as possible, minimizing your total wait time.
