Verify your credential equivalency before applying
PERM requires your foreign nursing aide certification to be recognized by the state where you'll work. Get your credentials evaluated through an approved body and confirm your CNA certification meets that state's reciprocity or endorsement requirements before any employer starts the labor certification process.
Target long-term care facilities with PERM history
Skilled nursing facilities and assisted living chains sponsor nursing aides for EB-3 far more often than hospitals. Search DOL PERM disclosure data to identify which facility groups have filed for this SOC code in your target state, then focus your applications there.
Search green card sponsoring employers on Migrate Mate
Migrate Mate filters jobs by employers with active green card sponsorship history, so you're not guessing which nursing aide postings include PERM support. Use it to surface facilities already familiar with the I-140 and adjustment of status process.
Confirm the employer will cover PERM attorney costs
DOL rules prohibit employers from passing PERM legal fees onto you. Before accepting an offer, get written confirmation the facility will pay for the labor certification and I-140 filing. Some smaller facilities try to shift costs indirectly through contract terms.
Understand how EB-3 priority dates affect your timeline
For most countries, EB-3 nursing aide petitions face no meaningful visa backlog, meaning your green card process can move from PERM approval to adjustment of status without years of waiting. Check the monthly USCIS Visa Bulletin to confirm your country's EB-3 priority date is current.
Use the OFLC Wage Search to benchmark your offer
Your employer's PERM application must certify your offered wage meets the prevailing wage for nursing aides in your county. Cross-check the offered salary against the OFLC Wage Search for your specific SOC code and geographic area to catch underpayment issues before the DOL audits the filing.
Green Card Nursing Aide: Frequently Asked Questions
Can nursing aide roles qualify for EB-3 green card sponsorship?
Yes. Nursing aide positions typically qualify under the EB-3 skilled worker or unskilled worker category depending on the specific duties and state requirements. Employers file a PERM labor certification with DOL first, demonstrating no qualified U.S. workers are available for the role, then submit an I-140 immigrant petition with USCIS. The process leads to permanent residency, not a temporary status.
How does green card sponsorship differ from H-1B for nursing aides?
H-1B visa requires a specialty occupation with at least a bachelor's degree, which nursing aide roles generally don't meet. EB-3 green card sponsorship has no annual lottery and no specialty occupation requirement. The process takes longer overall, often two to four years including PERM, I-140, and adjustment of status, but the result is permanent residency rather than a temporary work authorization that expires.
Which types of employers most commonly sponsor nursing aides for green cards?
Skilled nursing facilities, long-term care chains, and rehabilitation centers account for the majority of PERM filings for nursing aide roles. These employers deal with persistent staffing shortages, which makes the DOL labor market test easier to pass. Acute-care hospitals sponsor less frequently for this title because their hiring volume and turnover patterns differ from residential care settings.
How can I find nursing aide jobs that include green card sponsorship?
Most general job boards don't filter by PERM or I-140 history, so you're left guessing. Migrate Mate is built specifically to surface employers with active green card sponsorship records, letting you identify nursing aide postings from facilities that have already navigated the PERM process and are prepared to sponsor foreign workers through to permanent residency.
What happens to my green card case if I change employers mid-process?
If you leave before your I-140 is approved, your PERM filing is abandoned and the process restarts with a new employer. Once your I-140 is approved and your priority date is current, AC21 portability rules may let you change to a same or similar nursing role without losing your place in line. Consult an immigration attorney before making any job change mid-process.
