Document your supervisory scope precisely
PERM job descriptions must reflect what you actually do. List the number of direct reports, departments overseen, and budget authority. Vague titles like 'oversee operations' get scrutinized at audit; specificity protects both you and your employer.
Verify your role qualifies under EB-3
Operations Supervisor positions typically require a bachelor's degree or two-plus years of specialized training, fitting EB-3 skilled worker criteria. Review the O*NET occupation profile for this role to confirm the education and experience benchmarks DOL expects.
Target employers with existing PERM infrastructure
Search Migrate Mate to identify employers who have previously sponsored operations and logistics roles for green cards. Companies with established PERM workflows move faster and are less likely to abandon a petition mid-process due to unfamiliarity with requirements.
Understand the prevailing wage before negotiating
Your employer must pay at least the DOL-certified prevailing wage for your specific role and location. Use the OFLC Wage Search to look up the wage level for your SOC code before your offer stage so your negotiated salary doesn't fall below certification requirements.
Separate your PERM timeline from your H-1B status
PERM filing takes 12 to 18 months or longer before you even reach the I-140 stage. If you're currently on H-1B visa, plan renewals in parallel. Your employer can file your I-140 concurrently with PERM approval to preserve your priority date immediately.
Prepare a credentials package before the employer files
USCIS and DOL may request your diplomas, transcripts, and prior employment letters during the I-140 or PERM audit stages. Gather certified translations and notarized copies now so your employer's attorney isn't waiting on documents when deadlines hit.
Green Card Operations Supervisor: Frequently Asked Questions
Does an Operations Supervisor role qualify for EB-2 or EB-3 green card sponsorship?
Most Operations Supervisor positions qualify under EB-3 as skilled worker roles requiring a bachelor's degree or equivalent experience. EB-2 sponsorship is available if the position requires an advanced degree or your employer can demonstrate you bring specialized expertise that clearly exceeds the standard role definition. Your employer's immigration attorney structures the petition to match your actual qualifications and the job's documented requirements.
How does green card sponsorship differ from H-1B sponsorship for this role?
Green card sponsorship through PERM is permanent, not time-limited, and EB-3 for most countries has no annual cap backlog affecting immediate filing. H-1B is capped at 85,000 annually and subject to a lottery. PERM requires your employer to complete DOL-supervised recruitment before filing, adding roughly 12 to 18 months to the front end, but the outcome is lawful permanent residency rather than a renewable temporary status.
What does the PERM recruitment process look like for an Operations Supervisor position?
Your employer must run DOL-mandated recruitment, including job postings, internal notices, and in some cases newspaper advertisements, to document that no qualified U.S. workers are available for the role. The recruitment window typically spans 30 to 180 days. If the employer receives qualified U.S. applicants, the PERM application cannot proceed. An audit can add six months or more to the timeline.
Where can I find employers actively sponsoring Operations Supervisors for green cards?
Migrate Mate indexes employers with documented employment-based sponsorship history for operations and logistics roles, so you can filter by job title and green card sponsorship rather than sifting through postings that don't address immigration. Focusing your search on employers who have completed PERM filings before dramatically reduces the risk of starting a process that stalls because the employer lacks the infrastructure or appetite to follow through.
Can I switch jobs after my employer files my PERM or I-140?
You can change employers after PERM is filed, but the labor certification is employer-specific and typically cannot transfer. If your I-140 has been approved for at least 180 days and your priority date is current or close, AC21 portability may let you move to a same or similar role without losing your priority date. Operations Supervisor roles at similar organizational levels generally qualify as same or similar under AC21.
