Verify your surgical credentials transfer cleanly
PERM requires your foreign surgical technology credentials to align with the DOL-defined job duties. Get your training evaluated by a NACES-accredited agency and confirm your credential maps to the O*NET profile for Surgical Technologists before applying.
Target hospital systems with active PERM history
Large hospital networks and academic medical centers file PERM applications far more frequently than ambulatory surgery centers. Search DOL PERM disclosure data to identify facilities that have sponsored OR Techs in the past two years.
Use Migrate Mate to filter sponsoring employers
Searching broadly for OR Tech openings wastes time on roles that will never sponsor. Migrate Mate filters job listings by green card sponsorship history, so you're only applying to employers who have already navigated PERM for this role.
Understand how prevailing wage shapes your offer
Your employer must pay at or above the DOL prevailing wage for your specific OR Tech role and geographic area. Check the OFLC Wage Search before negotiating your offer to confirm the wage level your employer will certify.
Ask about concurrent I-140 and I-485 filing eligibility
If an EB-3 visa number is immediately available for your country of birth, you can file your I-140 petition and I-485 adjustment of status at the same time, cutting months off your timeline. Confirm this option with your employer's immigration contact.
Document your OR hours before the PERM audit window
DOL can audit PERM applications for up to five years after filing. Keep contemporaneous records of your scrub hours, specialty rotations, and any certifications like CST so your employer can respond to an audit without delay.
Green Card OR Tech: Frequently Asked Questions
What green card category covers OR Tech roles?
Most OR Tech positions qualify under EB-3, which covers skilled workers and professionals in roles requiring at least two years of training or experience. Candidates holding a relevant advanced degree may qualify under EB-2. In both cases, employers file a PERM labor certification with DOL before submitting an I-140 petition to USCIS, beginning the permanent residency process.
How does green card sponsorship differ from H-1B for OR Techs?
H-1B visa requires your role to qualify as a specialty occupation, which can be difficult to establish for OR Tech positions that don't uniformly require a bachelor's degree. EB-3 green card sponsorship through PERM has no annual lottery and no cap concerns for most countries, though processing takes longer. The end result is permanent residency rather than temporary status requiring renewal.
How long does the PERM and green card process take for OR Techs?
PERM labor certification currently takes several months to over a year depending on whether DOL audits the application. After PERM approval, I-140 adjudication adds additional time. If your country of birth has no visa backlog in EB-3, you can file I-485 concurrently with I-140. Check the USCIS visa bulletin monthly, as priority dates move and affect your timeline.
Where can I find OR Tech jobs with green card sponsorship?
Migrate Mate is built specifically for this search. It filters OR Tech roles by employer green card sponsorship history, so you're not sorting through hundreds of postings that have no PERM track record. This saves significant time compared to applying broadly and discovering late in the process that an employer won't sponsor.
Can my employer sponsor me for a green card if I'm currently on OPT or H-1B?
Yes. Employers can begin PERM labor certification while you're working in the U.S. on any valid status, including OPT or H-1B. Your current visa status doesn't affect PERM eligibility. If you're on H-1B and your I-140 is approved, you may be able to extend your H-1B beyond the standard six-year cap under AC21 portability rules while your green card case is pending.
