Real Estate Attorney Green Card Jobs
Real estate attorney roles at U.S. law firms and corporate legal departments qualify for EB-2 or EB-3 green card sponsorship through the PERM labor certification process. Your employer files the I-140 immigrant petition after DOL certifies the job, placing you on a path to permanent residency rather than a renewable visa cycle.

Get Access To All JobsTips for Finding Green Card Sponsorship as a Real Estate Attorney
Verify your degree meets EB classification
EB-2 requires a U.S. equivalent master's degree or higher, or a bachelor's plus five years of progressive experience. A foreign law degree evaluated as a J.D. equivalent can support EB-2 classification, so get a credential evaluation early.
Target law firms with PERM filing history
Large law firms and real estate investment trusts regularly sponsor attorneys through PERM. Search for employers who have filed LCAs for attorney roles in your target market, filtering by job title and state in the DOL's OFLC data.
Use Migrate Mate to find sponsoring employers
Filter real estate attorney roles by green card sponsorship history directly on Migrate Mate. You'll see which firms have filed PERM applications for attorneys, so you're targeting employers who have already committed to the process.
Check prevailing wage before salary negotiations
DOL sets the minimum wage your employer must pay under PERM using the OFLC Wage Search. Your offered salary must meet the prevailing wage for your specific SOC code and metro area, and negotiating below that floor can invalidate the labor certification.
Ask employers about their PERM recruitment timeline
PERM requires your employer to complete a documented recruitment process before filing. Confirm they understand this can take six to twelve months before the I-140 stage, so you're joining a firm prepared for the full commitment.

Find Real Estate Attorney JobsReal Estate Attorney Green Card Sponsorship: Frequently Asked Questions
Do real estate attorney roles qualify for EB-2 or EB-3 green card sponsorship?
Real estate attorney positions typically qualify under EB-2 if the role requires a J.D. or equivalent advanced degree, which most attorney jobs do. EB-3 applies when the position is classified as a skilled worker or professional. Because a J.D. is the standard minimum requirement for attorney roles, many sponsoring employers file under EB-2, giving candidates with advanced credentials a direct path to permanent residency.
How does green card sponsorship differ from H-1B sponsorship for attorneys?
H-1B sponsorship is temporary and subject to an annual lottery, which means your authorization can end or be disrupted. PERM-based green card sponsorship leads to permanent residency with no annual cap concerns at the EB-3 level for most countries outside India and China. The PERM process takes longer upfront, often 18 to 36 months from filing to approval, but the outcome is lawful permanent resident status rather than a visa you must continuously renew.
What does the PERM labor certification process involve for a real estate attorney role?
Your employer must conduct a DOL-supervised recruitment process to demonstrate no qualified U.S. workers are available for the position. This includes posting the job through specific channels, documenting all applicants, and filing the ETA Form 9089 with DOL. Once DOL certifies the application, your employer files the I-140 immigrant petition with USCIS. The entire process from recruitment to I-140 approval commonly takes one to two years.
How can I find real estate attorney jobs where the employer will sponsor a green card?
Search for employers with documented PERM filing history for attorney roles. Migrate Mate lets you filter real estate attorney positions by green card sponsorship history, showing you firms that have already gone through the PERM process for similar roles. Targeting employers with a track record removes the uncertainty of asking a firm to commit to a process they've never completed.
Can a foreign-trained lawyer qualify for green card sponsorship as a real estate attorney?
Yes, if your foreign law degree is evaluated as equivalent to a U.S. J.D. or master's degree by a credential evaluation service. The employer lists the degree requirement in the PERM application, and USCIS reviews equivalency at the I-140 stage. State bar admission is separate and determined by individual state rules, but the PERM and I-140 process can proceed while you pursue bar reciprocity or sit for the bar exam.
