Green Card Software Architect Jobs
Software Architect roles qualify for EB-2 and EB-3 green card sponsorship through the PERM labor certification process, where your employer documents that no qualified U.S. worker is available for the position. Sponsorship leads to permanent residency, not a temporary work authorization tied to a single employer's renewal cycle.

Align your credentials to EB-2 requirements
EB-2 covers advanced-degree professionals and candidates with strong credentials. A master's degree in computer science or a bachelor's plus five years of progressive architecture experience both satisfy the advanced-degree standard USCIS applies to Software Architect petitions.
Target employers with active PERM filing history
Search OFLC disclosure data to identify companies that have filed PERM applications for Software Architect roles in the past two years. Repeat PERM filers have established legal workflows, which shortens your time from offer to active filing.
Verify the job description matches O*NET
PERM requires the employer to advertise the role using DOL-compliant language. Cross-check the posted job description against the O*NET occupation profile for Software Architects to catch degree-requirement mismatches before the recruitment phase locks in the wording.
Use Migrate Mate to filter sponsoring employers
Filter Software Architect openings by verified green card sponsorship history using Migrate Mate. This removes companies with no PERM filing record from your search, so you spend time on roles where the employer has already demonstrated willingness to sponsor.
Negotiate filing timing before signing your offer
Ask the employer whether they will initiate PERM within 90 days of your start date. PERM recruitment, DOL review, I-140 filing, and adjustment of status each add months. Starting the clock early matters most if your priority date is subject to backlog.
Understand how country of birth affects your wait
EB-3 has no per-country annual cap concern for most nationalities, but applicants born in India or China face priority date backlogs that can extend the green card wait by years. Factor your birth country into the EB-2 versus EB-3 tier decision with your sponsoring employer.
Green Card Software Architect: Frequently Asked Questions
Does a Software Architect role qualify for EB-2 or EB-3 sponsorship?
Software Architect positions typically qualify for both tiers. EB-2 applies when the role requires a master's degree or when you hold a bachelor's plus at least five years of progressive, specialized experience that USCIS recognizes as the equivalent. EB-3 applies to roles requiring a bachelor's degree. Your employer's attorney documents the minimum requirements during PERM, so the job description wording directly determines which tier applies.
How does PERM green card sponsorship differ from H-1B for this role?
H-1B visa is a temporary status capped at six years in most cases, subject to an annual lottery, and tied to that specific employer. PERM-based green card sponsorship has no lottery, no annual renewal cycle, and results in permanent residency. The tradeoff is time: PERM labor certification, I-140 approval, and adjustment of status together take longer than an initial H-1B filing, and priority date backlogs can extend that further depending on your country of birth.
What does the PERM recruitment process require for a Software Architect opening?
The employer must run a DOL-mandated recruitment campaign advertising the Software Architect role at the prevailing wage determined through the OFLC Wage Search tool. This includes print ads, job postings, and internal notices over a set window. If no minimally qualified U.S. worker applies, the employer certifies that finding to DOL, which is the prerequisite for filing the I-140 immigrant petition on your behalf.
How do I find Software Architect jobs where the employer will sponsor a green card?
Search specifically for employers with verified PERM filing history for Software Architect roles rather than assuming any company that sponsors H-1B will also run PERM. Migrate Mate lets you filter Software Architect openings by green card sponsorship history, so you can focus on companies that have already filed for this job category and are likely to do so again.
Can I change jobs after my employer files the I-140 but before I get my green card?
Yes, once your I-140 has been approved for at least 180 days and your adjustment of status application has been pending for at least 180 days, you can port to a new employer in a same or similar Software Architect role without losing your priority date. This is called AC21 portability. Confirm the new role falls within the same occupational classification before making the move.
