Align your degree to EB-2 requirements
EB-2 requires a U.S. master's degree or foreign equivalent, or a U.S. bachelor's plus five years of progressive experience. Document your academic credentials and employment history before applying so employers can confirm EB-2 eligibility from the start.
Target employers with active PERM filing history
PERM-sponsoring Software Engineer employers cluster in tech, finance, and healthcare IT. Filter DOL disclosure data by occupation code to identify companies that have filed PERM applications for this exact role rather than relying on general job postings.
Search green card sponsors using Migrate Mate
Migrate Mate surfaces employers with verified green card sponsorship history for Software Engineer roles. Use it to skip manual DOL data searches and focus your applications on companies already filing PERM for this position.
Negotiate the sponsorship commitment before signing
Ask specifically whether the offer includes PERM sponsorship and at which EB category. Some employers default to H-1B visa transfers without committing to green card filing. Get written confirmation of sponsorship intent and expected timeline before accepting.
Check your priority date against the Visa Bulletin
EB-3 software engineers born in India or China face significant backlog waits. Review the monthly Visa Bulletin published by the State Department to understand your projected wait under your birth-country category before choosing between EB-2 and EB-3.
Prepare your O*NET occupation profile for PERM recruitment
PERM requires the employer to conduct good-faith recruitment before filing. Review the O*NET profile for Software Engineer to understand how DOL classifies the role's duties and minimum requirements, which directly shapes the job description used in mandatory recruitment ads.
Green Card Software Engineer: Frequently Asked Questions
What is the difference between H-1B and green card sponsorship for Software Engineer roles?
H-1B is a temporary nonimmigrant status requiring renewal every three years, subject to the annual cap and lottery. Green card sponsorship through PERM leads to lawful permanent residency with no renewal requirement and no cap at the EB-3 level for most countries. The tradeoff is timeline: PERM and I-140 adjudication typically takes one to two years before you can file for adjustment of status, and priority date backlogs for India and China can extend total wait times by a decade or more.
Which EB category do most Software Engineer green card cases use?
Most Software Engineer PERM cases are filed under EB-2, which requires an advanced degree or its equivalent. Employers sometimes file under EB-3 when the position is defined at the bachelor's level or when the candidate lacks a master's degree. EB-2 carries a faster priority date for most nationalities outside India and China, making it the preferred category where the role and credentials qualify.
How do I find Software Engineer employers who actually sponsor green cards?
The most direct method is searching DOL PERM disclosure data filtered by the Software Engineer occupation code. Migrate Mate aggregates this data so you can search by role and employer without downloading raw government files. Focus on employers with multiple PERM filings over several years, which signals an established sponsorship process rather than a one-off case.
Can I switch employers after my Software Engineer PERM is filed?
Switching employers restarts the PERM process unless your I-140 has been approved and you have been in adjustment of status for 180 days or more, in which case AC21 portability may allow you to move to a same or similar occupation. For most Software Engineer roles, a new software engineering position at a different employer qualifies under AC21 if the occupational duties are substantially similar.
What documentation do I need before a Software Engineer green card process begins?
You'll need an official copy of your highest degree, credential evaluation if it was issued outside the U.S., and detailed employment verification letters from each position supporting your experience claims. For EB-2 cases arguing equivalency to a master's degree, each prior employer letter must confirm job duties, title, and exact dates. Gaps or vague letters are a common reason USCIS issues requests for evidence during I-140 adjudication.
