Document your advanced degree credentials early
PERM requires your employer to advertise the role at your actual education level. If your degree is from a foreign institution, get a credential evaluation completed before the job offer so the PERM filing reflects the right requirements from day one.
Target employers with in-house tax departments
Companies large enough to have a dedicated tax department are far more likely to sponsor green cards than boutique firms. Financial services, energy, pharmaceutical, and Fortune 500 technology companies regularly file PERM applications for senior tax roles.
Search green card sponsorship history on Migrate Mate
Filter Tax Director roles by employers with active PERM and I-140 filing history. Migrate Mate surfaces this data so you can prioritize companies that have already sponsored senior tax professionals rather than starting cold outreach with unknown employers.
Understand the EB-2 advanced degree route for your profile
Tax Directors with a master's degree in taxation, accounting, or a related field typically qualify under EB-2. Your employer's immigration counsel will structure the PERM job requirements around your actual qualifications, so confirm your degree classification with them before the recruitment phase begins.
Ask about concurrent I-140 and I-485 filing timing
Once USCIS approves your I-140 petition, you can file for adjustment of status concurrently if a visa number is immediately available. For most countries outside India and China, EB-3 priority dates for Tax Directors are current or close to current, which shortens the wait considerably.
Verify prevailing wage compliance before accepting an offer
DOL requires your employer to pay the PERM prevailing wage for the Tax Director role in the specific work location. Cross-check the offered salary against the OFLC Wage Search using the correct SOC code for your role before signing, since underpaying triggers PERM denial.
Green Card Tax Director: Frequently Asked Questions
Does a Tax Director role qualify for EB-2 or EB-3 green card sponsorship?
Tax Director positions typically qualify for EB-2 sponsorship when the role requires a master's degree or equivalent in accounting, taxation, or finance. Employers who structure the minimum requirements around a bachelor's degree plus experience may file under EB-3 instead. The category your employer uses depends on how the PERM job requirements are drafted, not solely on your personal credentials.
How does green card sponsorship differ from H-1B sponsorship for a Tax Director?
Green card sponsorship through PERM leads to permanent residency, not a temporary work authorization period. There is no annual cap lottery at the EB-3 level for most nationalities, and once your I-140 is approved, your status is portable under AC21 after 180 days. H-1B visa is time-limited, lottery-dependent, and must be renewed, whereas an approved PERM petition locks in your priority date regardless of employer changes after that threshold.
How long does the PERM and green card process take for a Tax Director?
The PERM recruitment and audit process at DOL currently averages well over a year for analyst review cases, though standard processing can be faster. After PERM certification, USCIS adjudicates the I-140 petition, which takes several months without premium processing. For applicants from most countries other than India and China, adjustment of status or consular processing can follow relatively quickly once a visa number is available.
Where can I find Tax Director jobs where the employer already sponsors green cards?
Migrate Mate lets you search Tax Director roles filtered by employers with documented PERM and I-140 sponsorship history. Focusing on companies that have already gone through the PERM process for senior tax professionals saves significant time compared to applying broadly and discovering sponsorship willingness only after an interview offer.
Can my employer sponsor my green card while I'm on an H-1B as a Tax Director?
Yes. Your employer can begin PERM labor certification while you hold H-1B status. This is one of the most common paths for senior tax professionals already working in the U.S. Under AC21 portability rules, once your I-140 is approved and your I-485 has been pending for at least 180 days, you can also change employers as long as the new role is in the same or similar occupational classification.
